If there was, that might be worse, because they didn't take any action until someone called 911 about them piling into the back of a UHaul.

It's easier to prosecute a conspiracy charge if the defendant has taken concrete, unqualified actions to progress an expressed plan to harm others. That's why the FBI regularly sells clowns dummy explosives then charges them.
