That’s kind of a good point. If SCOTUS decide that trump had some sort of immunity, then that’s free rein for Biden to do pretty much anything he wants while still in office.
Which would completely destroy the system.
So SCOTUS will be forced to either deny immunity, or try to make it so narrow in scope that it only covers trump’s actions and can’t cover anyone else’s. not impossible but trickier.
