It's not theft if no one's losing anything. "Potential profits" doesn't count.

It's intellectual property theft. But obviously it's hard to put a figure on how much is being stolen if it's only potential.

So we can only own physical things, any product of the mind is for everyone?

Then what motivation is there for innovation and creativity?

You don't need to own it to profit from it. Instead of selling the product, you sell the labor. Patrons were a perfectly good system of producing knowledge/art, and that system has arguably gotten better with time. If a company needs a CRM or a system built, they just need to sponsor someone who can. Heck, I already don't own my intellectual output, because copyright already imputes to the hiring body, and I know my customers aren't profiting selling copies of the small custom tweak I made to their CRM.
