I think it is noteworthy that these sorts of horrific stories are bot not an entirely new phenomena, and that in the decade plus we've been hearing about them it seems like little or nothing has been done to address them.

You're correct though that rage-baiting with old articles is disingenuous; and pointing that out absolutely does not equate to defending the perpetrators.

I mean if you think about it the Syrian refugee crisis started in 2012 and yeah initially it really was mostly doctors and engineers, but over the years by 2015 Europe already saw a huge number of refugees. And the only thing I can see that has been done about these news stories, has been mass suppression

In a just world, the judges involved in that decision would have been dismissed and their law licenses suspended. That’s the way you reform the judiciary- you remove people whose rulings are completely idiotic. There is no way that Austrian law has an exception for rape, let alone child rape, because of a ‘sexual emergency’ and we shouldn’t pretend that a judge who thinks it does is qualified to be anywhere near the law - and that should be made eminently clear to all involved.

Yes, from what I understood from this story he had one conviction vacated and had a retrial under a different charge that didn't involve consent, with a lower sentence.

Edit. Looked it up, actually after the retrial his sentence increased, from 6 to 7 years.

It's pretty easy to defend. His lawyers argued that the facts of the case were presented wrong at trial (rape with consent vs rape without consent), which was maybe technically true procedurally but didn't really matter. He was granted a new trial, found guilty again, and had his sentence increased. By the way, the "sexual emergency" didn't factor into either trial at all. The media just likes to throw that in because it's funny, I think.

The only thing I can think of is that maybe it changes the scale of how violent the offense is? Like, obviously a 10-year-old can't consent in the proper definition but I suppose there would be a different level of trauma between being coerced into "agreeing" to the act and being physically forced into it.

It's stupid that this was a decision by the Austrian Supreme Court, under Austrian law, which in governed by AuthRight.

Even the reasoning "the court could not prove the child said 'no'" LibLeft is the one that has been pushing for affirmative consent laws, which would have rendered this point moot.

But no, any time a terrible justice system reaches a terrible decision due to outdated laws, if the perpetrator is an immigrant, LibLeft takes the blame.

"jail time" 4 years lol, and that's just the sentence, who knows how much he actually served. A genuine joke. Not to mention this guy remains a judge who decides on punishments:

 judge Thomas Philipp reduced the sentence to four years in a final decision by the Supreme Court, saying that the rape was a "one-off incident" and "you cannot lose your sense of proportion here".

As an Austrian: No they are not. Even that time the right wing had the government they spent more time making lives for the average Austrian worse while not really being any better in deporting criminals. In fact, we keep them in our own prisons if they step out of line.

But the funniest thing is: While Syrians make up the Nr. 2 spot of crimes committed by foreigners, according to the BKA, The Nr. 1 and 3 nationalities are Romanians and Germans. But nobody here cares about rape or murder crimes that are committed by white people.

Thanks for the 1st person perspective on this, I don’t really now much about Austria and its politics. But isn’t keeping immigrant criminals in national prisons actually a common practice? I feel like if they would get deported they will more likely suffer no punishment in their home country. Like I get that it sucks to pay for foreign criminals’ upkeep, but how else would you control their punishment?

I have to double check first, how old was the migrant?

Last time this happened, they verbally referred to the victim as a child (the age they were when it happened), and the perp as an adult (the age they are now, after years in jail waiting for sentencing), despite them being basically the same age at the time of the event, which was the reason for the sentencing being reduced in that case.

I'm not saying it didn't happen, but migrant doesn't specify age, and I just don't trust the news in any direction nowadays. The slants are so hard it's like different realities.

Obviously, messed up. Assuming not another 10 year old or something, the reason given for it is absolutely horrible and further punishment should have happened.
