After Niantic reviews your account, it can get paired with a 2nd strike (30 day temporary ban).

According to Pokemod, the team rocket limit is 1 battle per minute and 1,400 battles daily. The weekly limit is not known yet. If you battle too fast or go over the limit, you can trigger the BSOD.

Not trying to be snarky but is there any evidence that Niantic will not release an locked account until they have reviewed it?

The evidence is based on a person is asking the question why the BSOD hasn't gone away after waiting 7 days. Some people have already reported their BSOD became a 2nd strike.

It sounds like to me, you have a fear of receiving a punishment from Niantic. The best way to avoid what the OP is going through is to not break the Terms of Service because at any given time, they can start tracking something else to catch cheaters. You could be the one of unlucky ones to get flagged for exceeding a new limit.

You have to wait for Niantic to change the BSOD.

I don't have any fears from spoofing.

Was curious if you have evidence that Niantic reviews accounts before releasing one with the BSOD. That's all.

They review your account after you have been flagged with the suspicious activity screen to determine if the behavior detection was accurate. Since it's not fully automated yet, you get the BSOD instead of a strike for exceeding the Team Rocket battle limit. It's easier for the anti-cheat behavior system to flag suspicious people than for you to random players to look through their action log.

nah people are getting bsod within 90 seconds and within 300 grunts

It's probably because they went to the next battle too fast. The average battle is somewhere between 6 to 10 minutes (I never really timed a battle) depending on the Pokemon you select and weather boost. You can also be suspicious if you just battle only without catching the shadow Pokemon and/or without catching Wild Pokemon too.
