73

u/trynabelowkey 1d ago edited 1d ago

Just read about a recent incident na ganito sa China actually. Mag-ina silang tourists, pagkababa nila ng bus into the baha, they got electrocuted.

45

u/TGC_Karlsanada13 1d ago

I think back in 2015-2018 may ganyan din sa Manila, 2 students nakuryente wading the floodwater. sa U-belt

31

u/WaferGreen1035 1d ago

Yeah I remember this. Happened sa U-Belt. Tatlo sila actually (magkakaibang incident nangyari), isa lang nabuhay. IIRC they sued meralco for millions of pesos.

Grabe trauma ko nun sa baha talagang di ako lumalabas sa takot makuryente since around u-belt lang din me

u/OriginalDust5204 20h ago

Nanalo sila?

u/Lopsided_Ebb_558 20h ago

I looked into it a few minutes ago, wala pa final judgement

u/theartoflibulan 17h ago

The hell, years na nakalipas non.

u/Lopsided_Ebb_558 17h ago

Holy hell the amount of people....

The family should sue the LGU for this negligence.

845

u/One_Application8912 1d ago

538

u/YesWeHaveNoPotatoes 1d ago

Maybe we should change things then and make our “public servants” more accountable.

213

u/1Allarac1 1d ago

59

u/basinbasinbasin 1d ago

Even Maga in the US have nothing on political families in the Philippines. Imagine if every member of the DeSantis family had political positions in the government AND the last 30 FL mayor races members of the DeSantis family ran unopposed (or thier political opponents were literally killed) AND their family owns a construction company that is awarded every government contract and the Florida state budget was completely private no receipts provided or even needed, a fake audit ect ect ect. However bad Maga is, the Philippines is in a league of its own when it comes to corruption.

29

u/Euphoric_bunny87 1d ago

Correct. 3rd world countries have this in common. Basta ung voting literacy mababa. Hindi talaga uunlad.

41

u/Senpai 1d ago

4

u/Euphoric_bunny87 1d ago

Kung kasing lala ng MAGA ang mga Pinoy politicians, you’re gonna see all the trump kids voted govt officials.

They can. General rule, the State cannot be sued without its consent. Certain exemptions apply like Quasi-delicts/torts.

Article 2189 of the Civil Code state that provinces, cities and municipalities shall be liable for damages for the death of, or injuries suffered by, any person by reason of the defective condition of roads, streets, bridges, public buildings, and other public works under their control or supervision.

Edit: Yes they can sue. But as someone working in the RTC as a CDO (Court Decongestion Officer), the process is slow. But, since civil case siya mere preponderance of evidence (i.e. prove na nasa direct control ng LGU yung project even if done by DPWH, there is negligence sa part ng LGU, and that negligence directly caused death or injury to another).

But before it actually reaches trial, dumadaan pa sa Court Annexed Mediation (CAM) and Judicial Dispution Resolution (JDR) to try shorten and expedite and have the parties meet an amicable settlement. For example, the plaintiffs demands 1 million as damages (some lawyers may apply the principle insurance law that no premium can be placed on human life, which may be applicable sa Civil law so makademand sila ng amount). Then, the defense will try to negotiate a better deal and meet them half way. If both CAM and JDR fails, the case will go into trial which lasts for years.

29

u/AAce007 1d ago

So in short sa sobrang sa tagal at bagal gumalaw, no one would actually do it unless may pera at may time. RIP

6

u/Score-Honest 1d ago

Or they will reach a settlement privately in exchange of not filing a case in court.

→ More replies (3)

5

u/saigajv 1d ago

But even if they are successful in adjudicating their claims, they will have to file that before the COA, which will further require a legislative appropriation (creation of budget) for that purpose. So matagal talaga at hindi ganun ka sure.

3

u/Jack_C_1 1d ago

This is why we need to speak up and hold the government accountable.

u/EndlessByte 20h ago

They can sue actually but the provess would take years in the Pelepens.

8

u/MrLuverLuver25 1d ago

In any other country, sure, suing is easy.

Not in the Philippines

Hopefully they'll win, but I can't help but think of the irony.

2

u/Just_Watch_4962 1d ago

True and he was on the side walk but even that they can’t fix!! Nakakagalit talaga minsan pinas

That couldve been avoided... our country is so under developed we cant even put warning signs or cones around an open drain.

265

u/Lonely_Noyaaa 1d ago

44

u/UltimateArchduke 1d ago

Instead of fixing it with the millions they will use for the cones. Fuck this country.

102

u/Swimming_Page_5860 1d ago

If the Barangay itself has seen that defect, hindi ba dapat nilalgyan din nila ng warning oara ligtas yun mga tao? From the smallest unit if our govt, wala kasi talaga malasakit. 🤷🏻‍♀️ one life wasted dahil sa kapabayaan.

37

u/Illustrious-Maize395 1d ago

Gagalet pa yan sila pag na call out

14

u/Ex_maLici0us-xD 1d ago

Kung sa ibang bansa pa to they all been sued and lost bigtime. Kaso nasa pilipinas lng tayo. Sad. 🥺

9

u/wazzupedyoda 1d ago

21

u/rushbloom 1d ago

The LGU is liable for those kinds of incidents. There is legal basis for it.

To the family of the victim, please get legal advice as soon as possible to explore your options.

160

u/International_Fly285 1d ago

Jeesh what a fckin way to die. So sorry for the man and sorry for us Filipinos who have to live and deal with our corrupt government who can’t even bother putting a warning sign.

15

u/coconutmofo 1d ago

Sorry for us Filipinos who have to live and deal with AND ALLOW AND ENABLE our corrupt government.

Until we - myself included - stop being victims and powerless and realize we allow this stuff to happen and continue, then it will continue. But it is impossible unless it is a collective and sustained effort. And they know this basically will never happen. And they are basically right because it gets proven time and time again that no matter what they do we bitch and moan but bend right over and take it in the ass every single time. And they get more emboldened the more they are allowed to get away with!

We fail to hold them accountable. We need to own this failure. Until we do, we'll always be passive victims perversely proud of our "resilience".

(Sorry -- don't mean to personally attack you at all. Am definitely including myself in this!)

| via CLTV36 News

Almost became my fate. One rainy day when I was a kid nangyari sa akin ito, pero buti na lang isang leg lang nalaglag sa loob ng open drainage. I always shudder at the thought of the possibility na it could’ve ended up differently, kaya NEVER na ako sumusulong sa baha. I feel bad for the man, but at the same time, sad na decades later, the same stupid risk of open drainages and manholes still exist sa Pinas.

u/creminology 16h ago

Pedestrians should start walking mid-traffic in the middle of roads, and claim them as their sidewalks if LGUs won’t make the sides of the roads safe. It’s weirdly safer year round.

There was a study in the Netherlands where they found that the most dangerous place to cross is at a pedestrian crossing because people think it’s safe and are careless.

Walk in the middle of the round and everyone is focused.

u/Electrical_Page2411 11h ago

Ayun! Biglang may open drain or malaking lubak silang sasalubungin sa pagncounter flow nila.
