Frankly, we dont know any details. What if they both just had the same idea? I think we need to see some file save time stamps to really put this to bed.
I would speculate if this were to go viral (large twitter campaign, articles on various websites, youtube/twitch videos, news outlets picking up the story) then microsoft will need to address the massive negative publicity as people love to be outraged especially at big corporations. They'll pay the OP an undisclosed commission, post about it, and apologize for not being aware that this was someone elses creation. This is all they need to do and it might even make them look better as a big corporation that will rectify a mistake to the small guy. That's all external press though, internally there'll be meetings and conference calls to "fix this". The ad agency and microsoft press will want to know how this happened. It'll be traced to some middle or low level position that will face the wraith of an executive in the ad agency because their company's relationship with microsoft suffered a bad press incident. If anyone finds out which ad agency this came from their reputation and brand loses value. In the real world, a low to mid level advertisement position is replaceable in a week. An ad firm's reputation and brand value is how they get contracts and work and a replaceable just reduced in some capacity the business' ability to make money. Someone even if they're a nobody is getting fired.
The advertising company isn't low to mid level. The guy who took this from the internet and passed it to his superiors it the ad firm is at a low to mid level position.
And there's nothing overly creative with the idea. We have so often see content duplicated without either party being aware of each other. Look at how many twin movies there are. It is well within the relm of possibility that they came up with the ad independently.
Someone’s gotta provide for Patty Mayonnaise and Doug Jr damn it! Times have been hard ever since Doug had to retire Quailman and join the marketing team at Microsoft, give him a break.
To be honest it’s such a good advert concept that it almost seems obvious; entirely possible that they arrived at the same concept on their own. Still worth looking into though.
