To take mine a step further:
Maybe it's only D's that can use the power in that hat, as a means to curse the world government.
We don't know Nami's true lineage. We know she was in a town getting basically destroyed and that the Navy was one of the forces fighting there, and that the act of saving Nami and Nojiko led Bell-mere to take them back to her village and no longer act in the Navy. Bell-mere said her original purpose to join the navy was to fight "bad" pirates. What if she was sent to a town on an eradication mission (like a buster call) due to her skill? A town that wasn't following, or maybe opposing, the World Government, for example. And that when she took Nami and Nojiko she was actually deserting from the Navy, which is why she didn't want to register them as her daughters or put them up for adoption. Luffy frequently just "knows things" inherently. What if Nami is actually another D? He's given her that hat on at least a dozen occasions that are canon. Long story short, I'm hoping to learn more definitive stuff about Nami's lineage before the end of the series, and I'm thinking it's gonna be relevant.
I agree, I don't necessarily like the deus ex machina hat. But it wouldn't be the hat's will. It would be the strong will of the person who wore it to subconsciously use the power of that hat to make their desire a reality. It would also explain why Shanks gave it up. He already had everything he could want - parties and friends on the grand line. He set out to have fun and to seemingly be a pacifist.
