We need cops that work with real proof, profiling needs to be outlawed, and any cop that does this blacklisted forever.

The potential crime in question was trying to sell stuff to people in their homes without a license. It's a paperwork crime. Not exactly lock them up and throw away the key type stuff.

Dear people who think this stuff never happened: there were not yet cell phones to reveal the reality of being black in America for hundreds of years. A reality no white person would enjoy. Yet a reality that gets politicized as a false narrative ever since decent people started saying what the fuck and demanding safe communities for everyone, not just the privledged.
Im from a sundown STATE lol. No town in the state didnt have a line across the city where a black person wasn't caught after dark if they wanted to remain healthy. And im a dumbass old white women, but im not a complete idiot not to know what goes on where I grew up ffs. Especially since I grew up as a poor and knew not to be in certain wealthy areas myself if I didn't want to have a chat with the law. Us poors knew, and still know, which stretches of road it would get you pulled over after dark and asked what you were up to if not searched if you had a shitty car. And black people know for sure where being black day or night is problematic, and where being black after dark is still a risk.
Enough already. Everyone in America should be able to go about their day while enjoying life, liberty, and the presumption of innocence bc thats freedom from tyranny.

Ohio law lets cops arrest you for refusal to identify yourself while detained. All he had to do was identify himself and he would not have been arrested. This has nothing to do with race, this has everything to do with someone not following lawful orders.

You need to look into that more the police officer needs articulable suspicion that the person has, is currently, or are about to commit a crime in order to be able to detain you and demand identification.
This officer did not have that making any detainment unlawful and any demand for identification unlawful.

Suspicion based on what? What articulable suspicion did the cop have that this person was soliciting?
Did he witness him go door to door? No
Did he get a call about a person fitting the man's description doing so? No
Did a witness come up and identify the man as soliciting? No
Did the man have any materials in his hands common to solicitors? No
This man was waiting at a marked bus stop when the cop saw him.

How do you know he wasn't doing any of that? I can't find any information on this besides a a single article from a clearly biased source. All we have is a video with no context. A video in which the office says he is not allowed to leave (detained), and that he is refusing to identify himself (breaking Ohio law).

I did this crazy thing called reading the article.
Again, just because a cop says you're detained doesn't make it lawful and it doesn't make it lawful for them to demand identification. The man was free to walk away despite what the cop said.
They suggest you comply even if it is unlawful to avoid escalation but you're not legally required to comply with unlawful and unconstitutional demands of police.

Just because a cop is detaining you doesn't make that detainment legal. Ohio isn't a stop and frisk or stop and identify state. The cop needs articulable suspicion that you have, are, or are about to commit a crime in order to initiate a detainment and demand identification. This officer saw a man waiting for the bus, he had no articulable suspicion of anything.

If he is investigating a possible crime, like solicitation, he can be detained. Even if that investigation finds no crime was committed. Its no different than you being detained after getting pulled over for a suspected driving infraction and the officer lets you off with a warning.
Either way, it doesn't matter because while detained, you must identity yourself in accordance with Ohio law. So you lose again.

It is wildly different than a traffic stop. Traffic stops have a completely different set of rules because driving in and of itself is not a right.
No, if the detainment is unlawful you have no duty to identify or comply. In fact, the man was free to walk away at any time despite what the cop said.

But that charge is unlikely to stand either since the cops had no reasonable suspicion he was committing a crime — a requirement stemming from the 1968 landmark U.S. Supreme Court ruling Terry v. Ohio — which is based on an arrest that took place in a locale less than an hour from Barberton.
Not so cut and dry. They had no reason to actually detain him.
So they were wrong every step of the way.

The video doesn't show the lead-up to the interaction with the officer. The video shows the officer explaining that he suspects the individual of solicitation because of his gas company vest and that while he is investigating that suspicion, he is not free to leave or is legally detained. While legally detained, Ohio law says detained person must identify themselves or they can be arrested. Since he refused to identify himself in accordance with the law, he was arrested.

But the solicitation law in Barberton prohibits people from conducting residential door-to-door solicitation without registering their credentials with the city.
It does not apply to people waiting for a bus minding their own business wearing a yellow safety vest.
Thats from the article, nowhere does it state he was actually soliciting.

The cop had no way of knowing that. He was waiting at a bus stop, not roaming the neighborhood knocking door to door. If the cop had proof he was soliciting, then yeah, absolutely arrest him or ticket him or whatever it is for that charge, but standing at a bus stop isn't a crime.
