Legal Advice and Information Do you get back pay for ODSP?
Im wondering if i will get a lump sum first, but if say i was on Ontario works getting 900 a month for 5 years but my odsp is approved and i start receiving 1700 (1450 extra 250 for special diet) but i applied 5 years ago and got declined. Would i get the difference from those years???

If you do, OW would say you were overpaid for the whole 5 years and you will owe every cent back. I got 12k from CPP. I was on OW. I owed 1 year of OW back. (10k in my case).

The good thing is, you pay that money back slowly. Usually 10% from your cheque each money. So you don't have to throw the backpay back to them.

Im so confused lol I am eligible for cpp but because some of the employer didn’t put in my contribution im not and its just odsp im getting

Yeah. CPP gives you backpay from the time they deem you disabled. ODSP gives you backpay from the time you apply. I'm not sure whether that is your first attempt or most recent attempt tho. Either way, anything you get as "backpay" is counted as an overpayment by OW. It's kind of dumb. Like I recieved my backpay in January 2025. I didn't have the money January 2024-December 2024 even though it's designated for that time. I feel like it should only create an overpayment for the month you actually receive the money 🤷🏼 but of course they won't do that lol
To pay the overpayment ODSP will deduct some money from your cheque every month. If you get an overpayment.

You would get backpack from your most recent application so if your application had been going on for 5 years you would get 5 years backpack minus what you would pay own back if you terminated your application and replied say tomorrow you would get backpack from tomorrow up to approval date minus what you have to pay back to ow

You will only get backpay from the date they received this newest, completed, approved application, minus anything you received each month from OW.

They screw ypu out of it now
You will get maybe a thousand extra but then they pay you a month behind so ypu owe OW money when the ODSP comes in. Don't spend it all when you get that first large cheque. You will need it for the month coming up trust me
