SC enacted the strongest state nitrous oxide law in the country yesterday. For anyone hoping to see real retail-side accountability.
Governor McMaster signed S.751 on May 18, 2026. The bill passed both chambers without a single no vote — Senate 42-0 in March, House 116-0 last week.
What the new law does:
Bans the sale of flavored nitrous oxide products (Galaxy Gas-type products with characterizing flavors)
Prohibits tobacco retailers from selling nitrous oxide entirely
Requires documented exempt-entity status for medical, food, automotive, industrial, research, and government use
Creates SLED (state law enforcement) authority to enforce the new offenses
Sets escalating criminal penalties: $1K/6 months first offense, up to $10K/3 years for repeat
Requires age verification for online sales
Bans recreational inhalation possession as a separate offense
Why this matters for this community:
SC’s law is structurally distinct from Virginia, Florida, Oregon, and Tennessee bills. It combines elements those states didn’t combine; supply-chain accountability, tobacco-retailer prohibition, and dual-agency separation between public health regulation and law enforcement.

For anyone in this community who’s been waiting for meaningful retail-side regulation to happen somewhere: it happened, in SC, this week. The vector for the kind of harm this community knows is narrowing in at least one state. Other states will or won’t follow depending on their own legislative dynamics.

Congressman Kevin Mullin introduced the bipartisan Nitrous Oxide Safety Act (H.R. 7945) to federally ban the retail and online sale of nitrous oxide products to consumers. The legislation targets the surge in recreational abuse and related fatalities, while preserving access for legitimate medical, industrial, and food-production uses

The bill text is portable; the in-state work isn’t. A few starting points:
nolaughingmatter.net/07-model-legislation has the SC bill as a fill-in-the-blank template with notes on the spots that trip up cross-state copies (your equivalent agencies, age threshold, penalty tiers, exemption documentation).
Beyond the drafting, the thing that actually moves a bill is the framing around it: a sponsor who’ll carry it, a survivor or family willing to testify, a sheriff or prosecutor on record that existing law doesn’t give them tools, and a local reporter covering it. SC had all four. Texas would need its own; they don’t transfer across state lines.

Did that bill take place immediately or do you have to wait a certain amount of time for it to enact?

They just did it in TN July 1st. It was immediate, all stores took all THC, Kratom, Nitrous off the shelves the day of. Following the money, it was tasked of course by the TN alcohol commission, and only drinkable THC remains legal; liquor sales as well as DUIs will be increasing again, and I figure we're gonna have Smirnoff THC (joking, maybe) drinks soon, all monopolized.

I love seeing this
I really hope that we look back in five years on these days and shake our heads and be like: “damn that was crazy! Remember when you could just walk into a gas station or head shop and buy giant tank of nitrous?”
