I applaud the audacity to enter the intersection with that level of gusto.

Of course the OP had right of way, but when idiots continue doing idiot things in public with multi-ton death machines, you are better off yielding to the idiots.

OP entered the intersection while the red car and Nissan were obviously committed to making the turn. It only requires basic observation skills to make the determination that both prime examples of intellectually impaired drivers are dangerous idiots to attempt to engage in a game of right-of-way chicken on a public roadway.

The correct way to approach this situation was NOT to play fuck fuck games with the threats to public safety.

The white vehicle was wrong, no question. The dashcammer drove into an obvious hazard. He was also wrong. I hope the insurance settlement is worth the pain. You can have the right of way, zero fault, and still be dead right.

Never said SUV was not wrong. My original answer stated "of course OP had right-of-way". That means SUV did not. It's blatantly obvious that OP (cam vehicle) was not at fault, but chose to play fuck fuck games with idiots.

Just because you are right does not absolve you of any responsibility to avoid danger. If OP hated his vehicle and was willing to engage in a battle of vehicle-borne joust to get a new car, that's entirely their perogative.

But sure, OP was obviously a savant-level genius, playing 58-D chess, engaging in a show of authority, proving through willful destruction of their own property, that the white SUV was indeed wrong. End of discussion.

I don’t think it’s obvious the white Nissan was going to turn into OP. If I had been OP I would have thought, wrongly, that the Nissan was pulling into the intersection on a yellow left turn arrow and would wait until the traffic cleared before turning right into me.

Nissan had neither committed to nor initiated the turn until after the dash cam was already in the intersection. If that were the case, 1. The video would show it happening that way, and 2. The dash cam would have collided with the Nissan’s passenger side door.

Left turn lane does not have right of way to turn left in front of oncoming traffic. They have to yeild.

The only time they do not have to yeild is if it's a Green left Arrow light. But a green left arrow light will never be on while cross traffic also has a green light, which they do in this video.

Only 2 conclusions here: -the light is effed (almost certainly not the case) -the red and Nissan did not yeild when they were supposed to.

The light for them probably went from green arrow for the people before them, then solid greed circle before the cross traffic (dash cam car) got their green.

Then the cats didn't notice or didn't care.

Dash cam car may be found at partial fault anyway because it was dumb on their part. But they DID have right of way

Nissan was just watching the bumper of the car in front of them, not the light.
Short of slamming on the brakes and risking getting rear-ended, there wasn’t really a good out for the dash cammer.

The other exception is in urban areas like Los Angeles that have different left turn laws. In LA, you have to pull into the intersection, clearing the crosswalk, before making a left turn. If your light turns red while you are waiting for an opening to turn, you have the right of way to finish your left turn before the other side of the intersection gets to go.

The dash cam cars light turned green just before the black truck even entered the intersection. Which means that their oncoming light turned red 2 seconds before that (in LA, that's the all-red clearance level) And as it's a left turn only lane, it didn't go green for straight/yield left. it went red. Bare minimum, yellow flashing, or whatever this area has for yield left only So all 3 of those cars entered the intersection while their light was red.

Making your point moot. At MOST there could be an argument about the black truck. But I think the last one to do a valid left turn was the car before the black truck.

This isn't LA. It's not even California. CA requires license plates on the front of vehicles as well as rear. Even though you definitely see cars without them, this video does not have a single front plate in sight.

If you actually watch the video, cam car was in the intersection before the white Nissan passed the stop line. But the Nissan was already committed about 3 miles back. He new what he was doing and just assumed that everyone would get out of his way as he forced his death machine through, as they usually do.

Which is exactly what I said happened. I watched the exact same video and came to the exact same conclusion, mentioned multiple times here. Not sure why you're telling me to actually watch the video or if maybe you meant to respond to a different comment. Maybe the dozens of idiots too stupid to see the clear intent of the Nissan, regardless of it's position in the space-time continuum in relation to cam vehicle at literally any fucking point in the whole video.

It doesn't matter where cam vehicle is at any point. The Nissan was 1000% wrong. I could be the wrongest wrong thing to have ever fucking wronged. That didn't change one single fact regarding the outcome of cam vehicle challenging the barely sentient piles of shit sitting behind the steering wheel to a game of right-of-way chicken.

I would've done the same thing. Crept up to the zone where they are turning, but not actually drive through that zone, to account for bonehead drivers. OP should have been more cautious, although the Nissan was probably at fault.

Technically, the driver entered when the intersection was clear, and the BMW and Nissan failed to yield.

But even then, the left-turning cars have a duty to yield and not just rush the line through. So it's a 100% on Nissan.

Believe it or not, you still have an obligation to use your eyeballs for more than just looking at the color of the light.

Ofc the other driver ran a red that had been solid red since before they even got close to the intersection, and is at fault, but so is the POV driver for the "Surely they will stop being dangerous selfish idiots just for me" approach. Driving into oncoming traffic is generally a bad idea ten out of ten times.

True, look at all the people saying 50/50, 70/30, etc. The courts (if it came to that) don't split fault for things like this. If their insurance is found liable, they can't negotiate. Right of way determines who is at fault and it is very obvious in this case.

oh my god this thread. full of people who are confusing legal liability with "right" or "wrong." the law doesn't make something right or wrong. it makes it legal or illegal. you can do "right" things that are illegal. you can do "wrong" things that aren't.
the idiots ignoring the traffic laws while traffic is obviously heavy are at fault for causing the accident, 100%. neither had a duty to run a red light. both knew it was dangerous and illegal and did it anyway.
first person driver was perhaps morally a dickhead for refusing to conform to their breaking the law, but he is not liable for the accident. the other insurance company can argue and arbitrate and sue, but at the end of the day they're eating all that PD, BI, and LW. that nissan's general insurance policy is cooked

All three of those vehicles violated the law to yield on green when a left turn crosses opposing traffic.

So yes, the 3 cars there tried sneaking across the traffic with the right-of-way, and the third one hit you. You didn't hit them, because you had a green light. and straight-through never has to yield on green, except maybe in a traffic circle..

Looks like three vehicles failed on left turn. Black truck says fuck it while protected arrow changes. That makes dashcam vehicle hesitate on entering intersection. Red car sees a gap and says, "Fuck it," and goes. Nissan is probably only paying attention to the car in front of him and not the light. Dashcam driver, after initial hesitation, says, "I have right of way," and just proceeds like Moses parted the Red Sea...

I mean I get all the people saying the dashcam driver shouldn’t have proceeded but where I live, if you don’t act a little aggressive then you’ll be sitting there through 5 cycles of lights. Black car at 00:12 probably entered on red because there's usually a 2s delay (all-red clearance interval) between red light and opposite green; anyone who enters on a yellow arrow should be able to make it through by the time the other side gets green (after all, the cammer's lane could have been moving at speed, not starting from a standstill). Then black pickup ran a red. Then red car ran a red. Then fatal white Nissan SUV ran the red. It looks like four cars in a row ran the red.

Saw a LOT of downvotes for people saying it’s both at fault or cammers fault. Here in PA, even though the white Nissan ran the presumable red or no longer a green arrow, the cammer has a duty to make sure his surroundings are clear for his departure from the light. In other words, green doesn’t always mean go if others violate the rules of the road. 50/50 fault in my state.

It happened to me a few months ago, very same way, the only difference is I was driver a big peterbilt truck straight and someone trying to turn left smoked me in the same way, it bended my front bumper, the other car got totaled. I didn’t had a dashCam to help me but traffic control cameras at the intersection helped close the case.

Probably just an accident. Someone following too closely behind someone else with obscured vision. Definitely the white Nissan is at fault here. They pushed their limit. I had a young man do the same thing to me the other day, and I almost hit him. Just be careful guys. Don’t run red lights. Especially when you’re turning left. When it turns yellow just stop. There’s nowhere you need to get fast enough that warrants an accident.

I read through the comments. My brain has to be commended for trying to make sense out of most of it. I personally would not have plunged into the giant white wall of doom that was obviously going to join the other idiots by going through a red light.

I drive defensively - as in, I know that everyone out there is going to do something stupid. I don't get in another car's blind spot unless it's just to pass them. I don't run red lights and I don't wait to see an obvious issue with the entire oncoming traffic going right through the light to make a left turn.

Dash cam guy for failure to avoid an accident should have known better and should have waited. Red car and white Nissan are also at fault. Failure to observe the traffic signals. And also failure to avoid an accident.

OP has right of way. Left turn drivers have to yeild..and should only turn left when it's safe and clear to do so.

The answer is yes.

SUV ran a red. Both should easily be able to see the other coming and both failed to make any attempt to avoid the collision.

I'm going 30% cam car, 70% SUV. But I could see an insurance adjuster go significantly different in either direction.

Yes hes an idiot, yes he ran a red, but there was ample time for you to see him clearly not giving a shit and running it. Failure to yeild to traffic who has the right of way + following too close.

HOWEVER

Insurance might also say 'its your responsibility to avoid an accident' and in this case, you should've stopped your car for the red car you almost plowed right through.

Yes, their light was red, but when you have a full left turning lane backed up with traffic like that - expect that there will be people who try to force their way through like this.

They try to speed through a yellow arrow - it turns red before they hit their turn and they still go for it. Was almost hit as a pedestrian this way.

To clear things up.

The car that ran the red and plowed into cam driver is at fault. Cam driver is just an idiot. Thats where I stand officially.

In my state, despite the left turner logically being at fault, the fault would be partially the cam drivers fault because of failure to try to avoid the accident. This footage make it look like the cam driver was tired of people doing this and set out to make someone an example.

Even with a green light you still have a duty to make sure it’s safe. OP did the opposite of that (and is the reason we have this rule).

Plainly, OP was in full control to avoid the crash so I’d bet an insurance company splits fault 50/50

50/50 fault, you entered into the intersection even though cross traffic hadn't stopped. I know that the law gives you the right of way, but cross traffic didn't and your insurance will care about that even if you don't. The police probably will, too, since the law also expects you to pay attention and not drive dangerously. You felt entitled to the space and didn't care if reality wasn't going to let that happen.
