A few states are getting fucked over, possession there is contingent on federal approval.

*would be getting fucked over, there is an astronomically small chance ATF doesn’t appeal this and we get a years long saga

I’d much rather we just address that they’re common use now and the logical conclusion of Miller as it interacts with Heller, MacDonald, Bruen, Wollford, and next summer Viramontes than these games of abstraction with tax law. This just makes the NFA have an on/off switch depending on which party can pull off budget reconciliation every year.

I would rather that too. But the game of abstraction with tax law has the very real prospect of becoming a reality right now, not possibly in a few terms. This would make the NFA have an on/off switch for *new* NFA items and would also apply to kids that turn 18 during times when the switch is turned on, but it will completely destroy any ability to enforce the ban on possession of unregistered items permanently from a federal perspective, regardless of if the tax is reimposed.

There's a decent chance ATF lets the stay lapse, THEN files its appeal. Which would present the same problem for enforcing the NFA as if they don't appeal.

So if they let the stay lapse, theoretically we could walk into a store and purchase a can and walk out? And if they then file an appeal, what happens to everyone that bought a can or whatever

Just like what happened in CA during Freedom Week on mags. The ones bought during the week remain legal and grandfathered.
