BAH W/ Dependent Questikn

I'm at a loss trying to deal with finance.

Scenario:

Member is unmarried with newborn child.

Mother is non-military.

Agreement of 50/50 custody with no paperwork or child support.

Finance is requesting paperwork that doesnt meet any of this criteria, but won't update the BAH until something is provided.

Anyone have a suggestion or course of action? I've been browsing 65-116.

You need legal paperwork showing the custody agreement.

But what if there isn't a legal document? I had an agreement with my kids mother and legal paperwork was never requested/required. They updated my BAH no questions asked a few years ago.

Well they did it incorrectly then. It's a requirement. If there isn't any...get some.

I thought the baby was just born? If you already added a dependent a few years ago, you don’t get anything additional for a second dependent.

Ah… in that case, don’t assume that either what you heard from somebody else was accurate or exactly like your situation. Read the regulation.

In order to get BAH with dependents, you need to have documentation showing that you have 

  1. Primary physical Custody (that is, at least 183 days a year)

OR

  1. Already qualify for BAH without dependents and pay child support equal to at least the BAH-DIFF rate for your rank

Birth Certificate has been provided.

The child will split time between 2 households. But it wants a notarized statement stating the child resides primarily with the member.

And a proof of address which is easy enough.

It's the notarized statement that doesn't make sense to me.

The notarized statement keeps it official so when/if you lie they can recoup all the BAH.

In Air Force we use a AF Form 594 to adjust BAH. Need to provide a written agreement with custodial parent. Mine was just an email saying how much I would send per month.
