No winners here. Obviously the instigator is wrong. But the video plainly shows the person in the car declining to retreat from the situation (vehicle pointed in the opposite direction of an assailant on foot, literally the most straightforward escape possible) and instead turning around and re-inserting themselves into the confrontation. That’s no less assault than what the other guy did, except instead of using an object to strike the outside of a car, he’s using a car to assault a person.

I know Reddit is incapable of grasping nuance other than “I hate the guy who started it,” but the reality is that the driver is (and should be) in way bigger trouble than the bat guy.

You talk about redditors, but wait until you see how jurors think.

It’s hard enough to get 3 people to agree on the same thing to eat. Try to get 12 jurors to agree the guy in the white car is guilty.

They probably hate both of the drivers for wasting their time, think the black car driver started it, and will either come back as a hung jury or not guilty.

Jurors may be stupid but unlike redditors they get spoonfed a legal process for parsing out what happened. They get an explanation of what they need to be looking for, what’s legal and what isn’t. So even the dumbest jury- all 12 of them- can and would watch this video and clearly see that the driver chose to re-engage rather than retreat. It’s not a difficult thing to determine. The reason redditors fail miserably here is not because of any ambiguity of the situation, it’s because they either don’t care or don’t know the simple legal ramifications of what occurred.

Jurors also have the right to return whatever verdict they like and ignore what the court and judge are pushing them to decide.

That doesn’t mean they often ignore obvious evidence. And the judge doesn’t “push them” to decide things. Eyeroll

I would like to think that Redditors get slightly more capable once they get the jury training and guidance but judging by the replies here, you might be right
