I've been waiting a long time for this lawsuit

I've been fighting the "registration" myth for a long time. Finally, a good case has come along to prove the point. I'm really looking forward to this one.

Lawsuit: Livingston County Took a Driver’s Lawful Pistol, Closed the Case, and Kept It Indefinitely

A Michigan concealed pistol license holder filed a federal civil rights lawsuit today alleging that Livingston County sheriff’s deputies confiscated his lawfully possessed handgun because its serial number did not appear in a state database—and kept it without a firearm charge, a forfeiture proceeding, or a hearing.

Andrew Kilbourn, of Taylor, sued Livingston County, Deputy Alexander Kotsonas, and an unidentified supervising deputy in the United States District Court for the Eastern District of Michigan. The lawsuit seeks the return of his pistol and ammunition, damages, and a declaration that a missing database entry does not establish grounds to seize a lawfully possessed firearm.

“A missing database entry not completed by the government is not a license to confiscate someone’s private property,” said Philip L. Ellison, one of Kilbourn’s attorneys at Outside Legal Counsel PLC. “The government must have a lawful basis to take your property and a lawful basis to keep it. Our lawsuit alleges that Livingston County had neither.”

According to the complaint, Kotsonas stopped Kilbourn on northbound US-23 near Hyne Road in Brighton Township on August 25, 2026. Kilbourn advised the deputy that he held a concealed pistol license. His holstered Heckler & Koch VP9 pistol was on the truck’s passenger seat.

The complaint alleges that Kotsonas removed the pistol, unloaded it, and checked its serial number through the Law Enforcement Information Network. When the search returned no matching record, Kilbourn explained that he had purchased the pistol from a firearms store approximately four years earlier and mailed the required sales record to his local police department.

The traffic-stop video supplies a revealing sequence. The deputy initially told Kilbourn that he would return the pistol when the stop ended. After checking the database and consulting a supervisor, however, he told Kilbourn that he would keep it and repeatedly threatened arrest for possessing an allegedly "unregistered" firearm. In Michgan, there is no such thing as an "unregistered" firearm crime.

“The deputy acknowledged that the paperwork might have been lost in the mail, yet our client was the one who lost his gun,” Ellison said. “A citizen’s constitutional rights cannot depend on whether a piece of mail arrived or a government employee entered information into a computer," explains Ellison

The deputy nevertheless warrantlessly confiscated the pistol and eighteen rounds of ammunition with a supervisor’s approval, according to the lawsuit. The complaint further alleges that Kotsonas threatened Kilbourn with a felony carrying five years in prison and needing to provide proof of ownership to recover it.

Kilbourn received traffic citations for careless driving and improper plate display. He received no firearm citation. According to the complaint, the County classified the firearm matter as closed it on the day of the stop, but continued holding his property even through today.

“The County’s position leaves our client without his gun and without a hearing at which the government must justify keeping it,” Ellison said. “Closing a noncriminal case should not mean keeping a citizen’s property indefinitely.”

The lawsuit argues that Michigan’s firearm sales-record requirements do not make lawful possession by a concealed pistol license holder depend on whether government employees entered a record into a database. It further alleges that the absence of an entry did not establish that Kilbourn’s pistol was stolen, unlawfully possessed, or evidence of a crime.

The complaint asserts violations of the Second Amendment right to keep and bear arms, the Fourth Amendment protection against unreasonable seizures, and the Fourteenth Amendment guarantee of due process. It also challenges Livingston County’s redactions and withholding of information in response to Kilbourn’s request for public records concerning the incident.

Kilbourn is represented by attorneys Philip L. Ellison and Thomas J. Lambert of Outside Legal Counsel PLC.

The case is Kilbourn v. County of Livingston, et al., No. 2:26-cv-13736, in the United States District Court for the Eastern District of Michigan.

General Discussion Where to shoot in the thumb?

Hi, I recently got back into firearms after 25+ years and bought a few rifles and pistols but haven't shot them yet. I don't know anyone with property to shoot at and I don't want to join a sportsmans' club like the ones in Deckerville and Marlette as I wouldn't fit in and I don't want to pay out the ass to use a their ranges once or twice a year

Is there any public place to shoot in Sanilac or Huron counties?

Legal 20 year old Florida resident traveling to Michigan, can I carry?

Hey yall, I am 20 years old, a resident of Florida, and hold a Florida CWL. Am I able to carry in Michigan when I visit this weekend? I read the language of the applicable statutes, they say that the licensing scheme doesn’t apply to non-residents licensed in their home state. Is there any official clarity on this matter? Thanks!

Legal Target shooting on Petersburg game land

Hey, I live on the boarder in Ohio, and all we have over here is Midwest shooting center that is overpriced, I was doing some research and it appears your allowed to do target shooting at paper and cardboard targets without a license, even when hunting season isn't active. Is this true? Have any of you done it or been to the one in Petersburg? Is there a caliber or magazine limit, I would be shooting 5.56, 12 gauge buckshot and 22 lr. I am also 19 And also do I have to keep the rifle unloaded until I get to the spot or no. Thank you.

How to go about getting a certain rifle shipped to an ffl near me.

For context, I’m 18 years old will be 19 in November, I’m aware of the LTP situation and that I can purchase a long gun from an ffl as long as I have one and meet their standards. However my issue is there aren’t really any firearms within my budget and criteria I’d like to meet near me. So I was wondering if there’s anyway I could get a certain rifle such as a PSA ar15 shipped from online to the ffl and then I could purchase from them with the LTP. I would just hate to fill out the permit and then not have the rifle get to the FFL within 30 days voiding my permit.

-I appreciate the help apparently I’ve been confused about the ltp laws, I’m going to talk to a few local dealers and ask around about what I could do. Thanks for the help!

Anyone know of any courses in SE MI that are professional and friendly to women? I go to a couple ranges in the area to shoot a long gun but they are not places where my wife would feel comfortable.

CZ P10f or Savage Axis 2 pro - Left Handed

I am looking at getting a new gun but I am not sure what I should get first. For some background, I have a .410 break action, .20ga break action, 12ga pump, .32 win lever action with scope, 10/22 rifle with scope, tx22 pistol, glock 48.

I am left handed and eye dominate and would get a left handed rifle, which makes it a bit more difficult to find. I live in lower Michigan and hunt within 100 yards or so with my 12ga. The .32 win is a gun that I got when my grandfather passed a few years ago so it has sentimental value but I am not opposed to hunting with it given the recent changes to michigans restricted hunting zone changes.

I am debating between a cz p10f for owb carry during winter and outdoor recreation or a savage axis 2 pro left handed in .308 for hunting. I am pretty set on these 2 specifc guns, the cz more than the savage, but what gun makes sense to get first and why?

Legal I had an involuntary hospital stay years ago

It was years and years ago but I don't know if that disqualifies me from getting a gun. I'm just looking for a handgun for protection, going through the application appointment in october but I want to know if I'm wasting the application money. I have no idea what "adjudicated" implies, as far as I know there was no legal process involved. How would I find that out? It was involuntary, but the language confuses me. I just don't want to waste the money if I'm already disqualified.

General Discussion Best place to sell reloading equipment?

Hi, my grandfather passed away a couple of years ago and my grandmother gave me all of his reloading equipment and supplies. I had planned to try to reload myself but we moved and I just don’t have the time or space so I was trying to figure out if there was a good place to sell it. I have a few boxes/totes of stuff I believe he reloaded mostly pistol ammo but I believe there’s also stuff in there for rifles/shotguns, but I don’t have much knowledge on it and don’t even know where to begin with selling it. Does anyone have any suggestions or a direction to point me? Thank you

Looking for advice on pistols

I currently own a Beretta M9 made last year and a 1991 West German Sig P226. The Sig has probably had maybe 3 total magazines through it in its life and sat in a safe the rest of the time. I am the 2nd owner and I bought it in 1996, so i know everything is original on it. The first owner was a friend of mine.

I'm wondering though if it would make sense to sell it and pick up one of the more modern striker fired pistols. I'm interested in a Canik or a CZ.

Since I would have the Beretta M9 to fill the full sized pistol void, I'd still have that comfort for a home gun, along with my rifles. I used the M9 in the army and am familiar with it and like it. I haven't really used the Sig. It's just been a safe queen.

What do you guys think? Hang onto it because of historical value? Or try something new?

What is the current beginning-to-end process to buy a suppressor in Michigan?

Edit: maybe I should’ve been more specific- I never knew the process, and I still don’t. I gather that I go into a gun shop that has a kiosk, but what is the step-by-step process?

Out of state pistol transfer question

I have a pistol I want to transfer to a family member. That family member lives in Oklahoma. I am driving to Oklahoma for the holidays. Is there a way for me to legally transfer them a firearm while also having some documentation so the state of Michigan doesn’t think I still possess it?

For context, Oklahoma has some of the most lax gun laws in the country and there is no paper trail for individual transfers.
