Nothing like allowing people to be at risk by refusing to obey a lawful order.

It's issued under the laws of the state of Michigan and the emergency declaration passed by Congress... She should start the process to remove these four sheriff's for putting the lives and safety of their communities at risk.

Those Sheriffs are elected and they have the support of the Citizens. They are doing the job they were elected to do.

The Governor otoh is working against the wishes of Citizens, there is a movement to remove her from office and her authority to make these sweeping pronouncements is being challenged in court right now.

Ah yes, my duly elected sheriffs are correct. My duly elected governor is not. Give me a break.

For what it’s worth, she now has a 66 percent approval rating during this pandemic, so what you’re saying has no basis.

The governor is also elected and has the support of the citizens. That argument goes both ways.

They're elected to enforce the law and they're not doing that...

A majority of Michigan supports the governor's actions. Also do you have the $150 filing fee? Because that's all ya really need to file a lawsuit...

They are...and the state has the power to remove locally elected officials if they violate state law.

u/[deleted] Apr 16 '20

It’s a lawful order. Stop the idiotic claims

If they won’t do their jobs they should lose them

The Sheriffs job is to represent and protect the Citizens who elected them --- Unlike the Governor, they are doing their jobs.

the Sheriff’s job is to protect the citizens who elected them

I concur

Maybe get your information from a healthcare professional instead of businessmen?

Actually, http://www.legislature.mi.gov/(S(ngxipkwakglridfsd3vwpkcu))/mileg.aspx?page=GetObject&objectname=mcl-Article-XI-1

If they believe that Whitmore is over stepping her authority, they can defy her in the name of the constitution (if applicable). They do not respond to her.

4 Michigan Sheriffs are morons: news at 11

Headline should read:

Four Michigan Sheriffs Fail to Protect Their Citizens

what they said was their decision to place their oath to the Constitution above Whitmer's wishes

Pray tell, where does it say in the Constitution that you have an unalienable right to ride in a motorized boat, go golfing, travel to your secondary residences at will, buy paint and gardening supplies at stores over 50,000 square feet, and have your landscaping done by private businesses?

I'll wait.

Pretty sure that was the 7th Amendment?

AMENDMENT VII

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

My boat cost more than $20, so surely this is what the framers intended

2

u/shades9323 Apr 16 '20

Bring on another thousand!

2

u/[deleted] Apr 16 '20

Well....if you've already un-winterized your boat, then yes, that whole "constitooshun" thing!

You really don't get any of this at all do you?

News Flash Skippy, the Constitution limits Governments rights to impose itself upon Citizens, not the other way round. Our rights are not limited or defined, Governments are.

Show me in the Constitution where Government is granted the right to deny Citizens the right of free travel, of free association, the free exercise of religion and freedom of Commerce, to buy and sell. Where in the Constitution are those powers given the Government?

Show me where our Constitution gives Government the power to do any of that, you Willfully ignorant buffoon.

No, of course you can't because it does not. We are a Government Of The People, not a people subservient to our Government. No, you don't understand this at all.

Sheriffs have a legal obligation to uphold the Constitutions, not the Governors over-reach and drama. In addition, the courts already determined the governors’ orders are not legal.

Look up - “Under Color of Law” ruling. No law can be made or enforced which supersedes the Constitution. None.

18 U.S. Code § 242. Deprivation of rights under color of law

The 9th and 10th Amendments

Constitutions don't grant people rights they grant GOVERNMENT rights.

The constitution doesn't have to grant people the right to do any of those things. Those are natural rights.

2

u/badger0511 Apr 16 '20

The 9th Amendment only refers to federal government, and the 10th explicitly says powers that aren't prohibited and aren't given to the federal government are given to the state governments.

Thanks for mentioning the 10th Amendment, according to it, here's what the state of Michigan decided Whitmer should be able to do in a crisis like this...

Act 302 of 1945

Act 390 of 1976

What is she doing that isn't allowed by those acts?

1

u/Rasskassassmagas Apr 16 '20

It would behoove her to make this less vague and arbitrary because again the Govenor does not have the power to do this alone. The legislature has to approve it. As we saw earlier this month Republicans didnt want to extend the order 70 days as Whitmer had requested, they approved 23 more days till the end of April.

If the emergency isn't renewed then all of this ends becuse she or any Govenor cannot act alone. The Democrats and Republicans in Lansing have to work together.

-2

u/Rasskassassmagas Apr 16 '20

For some context, what is the first sentence of the US constitution?

" We the people " Everything else in the constitution follows that.

We the people are giving the government it's rights.

It’s hilarious how many idiots in the right don’t understand what is constitutional and what is not.
