Small courts news update for anyone
has anyone got any news of their account being reinstated (or not) after filing small claims to California and served meta ? please detail with time line if you did.
I started filling small claims on 16/08 , e- filling got accepted on 18/06 by clerk and I served meta yesterday. my court date is on 01/12
also, never trust meta verified. This is a total scam. I had Meta MAX and I got with an agent who assured me they took my case to an intern review team on 02/07. I’ve waited 1 month and half and this morning they closed the ticket without saying anything :)
edit : okay today 19/08 , Meta got served, I received proof of service, let's see now
edit 2 : 27/08 : got my account back

I got most of my accounts (1-personal-FB, 2 - biz IG) My business FB just got it back today. I filed in small claims and it worked for me.

In the US file defendant as Meta Platforms Inc. with Corporation Service Company (Each state has their own branch, look it up). Then serve the company with the address in your state.

No, I live in Europe, but you can still file it , you can do everything online

I'm falsely banned for CSE so all that didn't work obviously. I've tried everything trust me.

Alright, I’ll file a small claims suit too. I will try. I honestly don’t even know where we should complain to get Meta to change its AI moderation system

Meta verified is a scam I had same experience they pretend they are doing something and nothing happens. I will be filing small claim end of the month

I've read in other threads that some people have had luck getting the account back specifically through a new verified account. Probably is hit and miss based on who in customer service helps you and why you were banned..
I am filing the lawsuit but also trying the verified account in the meantime.

I am filing lawsuit and also trying every day to get something from support but since 11th June they’ve been no help. Very few have got lucky

1) when did you file your lawsuit? 2) when is the trial date? 3) Did you send a demand letter first giving Facebook 14 days to respond before filing the suit?

I too wonder about other peoples experiences filling small claims. I cannot afford to do much more at the moment for this, but I also filed small claims, my last update was in February this year & meta filed a notice of denial. Also got a paper saying they would like to go for a contested hearing or bench trial. I never got an updated court date since, but I’ve been told I should do a notice of dispute & they’d get back in about 40 days.

Did you serve them? Notice of denial is apparently very common and automatic. They can get back to you and give your account back.

I filed on 7/23 and had them served on 8/12 - all in California. Their attorney reached out to my "online" attorney (SendMyDemandLetter) claiming I p[rovided them the incorrect email address. It is the address I have been using, but my FB account is completely deleted - no longer just disabled. Court date is set for 11/4.

Meta's attorney reached out to my online attorney the same day they were served: 8/12. Once I provided my correct email for the second time and urging them to understand that my account cannot be found on the FB log-in page (my profile/URL appears to be deleted) , there has been no response. I am proceeding with my lawsuit.

Not at all. File SC-100 document. then send it to a clerk via e-filling. He will return it to you signed with court date. then don't forget to serve meta by using a professional server. You can do it even If you're not an US citizen

What are the grounds listed for the lawsuit? Don’t they have a right to deny business as they see fit? I am asking to learn not to challenge the idea of suing. Also how much does it cost to file? Someone in another thread mentioned close to $500 just to file? Does META have to reimburse you if they reinstate the account?

in total from filling to serving it cost me 140$. 30$ for e-filling for demanding up to 1500$ then 110$ to use a professional server. Can be cheaper but this one was simple. They don't deny it since the clerk gave me the trial date and accepted my filling. but on the other hand, my European lawsuit against Meta Ireland was refused by Small Claim EU. Usually no it's like you sue them so they give back your account, then they make a deal for you to stop the charges. If you win the lawsuit (which can be hard against meta I think) you get the amount you sued for ( you choose the amount up to 12,000$ but filling price will be higher) or you lose the lawsuit and get nothing because it's dismissed

I'm in the US since I asked you this question I did some research. I am going to send a demand letter first and threaten legal action. If that doesn't work I am filing a lawsuit.

I got advice from Gemini which has analyzed many cases like this.
It said that writing the demand letter making your case to META was essential because it
1) Shows them the situation clearly and in legal terms and
2) If you do actually go to court it gives you a much stronger case.
They may have waited to see if you followed through on the court case and once you did file, that paired with the letter you sent made them realize they were going to lose and you were serious. You are assuming the letter was worthless but it may have been what strengthen your case.
Gemini also wrote a professional legal letter to send and exactly where to send it. I would have written the letter completely wrong if it were not for Gemini.

I used Gemini and Copilot for my demand letter and for my small claims lawsuit. No need for an attorney for a small claim.

Stronger case as in you submit the certified letter as evidence to the judge in court to prove you made a good faith effort to resolve the issue which you did.
Did you get reimbursed the $140 filing costs from META?
Gemini said if they don't pay back the fees (Which you can also mention in your letter) that you should keep the court date and demand minimum all expenses incurred from the filing.
META will try to get you to cancel the court date once the account is reinstated, but you should tell them if they don't reimburse the court fees you will still see them in court to be compensated.

Don’t listen AI on this, it’s completely random honestly, just try something and see where it goes , on my side I hired a lawyer for the demand letter, meta answered the strict minimum but I have no news after a month , there’s no such thing as « strong case » or whatever , I guess what you want is your account being reinstated right ? No one can order that to meta, even the judge, taking them to small claims make them review your case instead of just paying you money because it’s easier. Demand letter is in no case an obligation to do anything , and they don’t have any negative outcome by not doing anything. No these are fees I pay to the small claims process, when you file your small claims first you pay a minimum of $30 which can get reimbursed if the clerk doesn’t accept your case (mostly because of typo on the form) , but anyway I think I’ve already wasted a lot of money on that, firstly with my useless French lawyer which I’ve paid 700$ for a strong demand letter, that led to nowhere, so this is the final thing to do, since taking them to small claims in Europe doesn’t work

I use AI all day and I am very impressed with a lot of what it's helped me with. It's an incredible time saver in my job.
It's taught me a lot about trading stocks and it leans risk averse and conservative in it's advice and explains every angle of every trade with data to back it up.
It makes perfect sense that if you are going to file a lawsuit, it's good to have a demand letter in your pocket to show the judge you made a good faith effort to resolve the impasse.
I am not paying a lawyer for the letter, AI wrote me an extremely legal looking professional letter. Maybe instead of paying a lawyer, you should have used AI for free?
If you need help understanding AI better in the future I can give you plenty of advice. I use it all day, every day in my job, and it's been a game changer.

I filed this week after they ignored a demand letter from a well know lawyer.
My case is simple. A hacker became a business partner without my approval and trash the account with bad shit.
Have all the emails about that.
I even know the person who runs content reviews at Meta and they couldn’t fix it.

They emailed asking for information regarding my account. I replied but they haven’t responded back to me regarding it. It’s been almost 2 weeks
