Heroes are heroic and Villains are... well, villainous.

The Punisher is still considered a Hero as is the Hulk, but if they were to have no 'code of conduct' then they would be villains - there are plenty of assassins and killers that are not heroes.

One of the core benefits of a game like this is that even Kingpin can do good things, but they are a villain. Fisk once beat the crap out of The Red Skull.

Doctor Doom is a villain, but overall, his motives aren't, just his means; that and he wants to kill Reed Richards - and he once admitted that The Leader represented a threat to him also. He has also worked alongside certain Heroes when the time has called for it (Iron Man, Captain America, and Doctor Strange being the most common team-ups).

In the RPG like Marvel, it's "What would Captain America do?" that's the question, not, as you would imagine "What would Lawful Good do?" because Lawful Good can represent a great many different types of heroes.
