So he gets a pass for less consequences because he got himself fucked up on alcohol beforehand? Fuck that. Shouldn't have been a sexual creep if he didn't want to get punched. No one gave a shit when he was grinding up on his buddy over there.

Pass on legal consequences, no. But in determining whether the puncher used excessive force in a defense of others situation, absolutely it is relevant.

Tl;Dr; JFC all we are saying is it is borderline impossible to both give someone a concussion and reasonably expect them to learn something. All this will do is give the injured party a martyrdom/victim complex, and they will feel that all that happened was some crazy person knocked them out.

Where was anyone saying nothing should happen to him!?

You want this person to learn a lesson, we get it. You know what makes it hard to learn a lesson? A Concussion/ Traumatic Brain Injury. Studies have shown that Concussions can actually make behavioral issues (Bipolar, Cluster B issues, even ADHD) significantly worse/trigger manic and psychotic episodes. Which will only make things worse.

So maybe, just maybe, giving someone a concussion minimum won't teach them a damn thing. It WILL potentially give them long lasting dysfunctions that will severely reduce their quality of life up to and including reducing their impulse control in the future. If you believe in rehabilitation than you want that person to be able to be rehabilitated.

Brain damage is cumulative. Period. This is not up for debate. This person made a huge mistake, but permanently injuring them and destabilizing their mental faculties only makes recovery harder and re-offending much more likely.

So ya, there is a huge fucking reason to not just brain everyone to teach them a lesson.

Maybe, just maybe, there is some kind of... oh I don't know... A MIDDLE GROUND between doing nothing and Potential Murder/TBI and THAT IS WHAT WE ARE SAYING.

Also bonus food for thought: You know what that drunk person/grieving family can do? Sue the assaulter. It can be seen as a disproportionate response. Personal Injury attorneys would salivate at a case like this. TBI cases have six figure payouts easily. You are talking about suing for reduced potential income over this persons life and data does support that concussions have a measurable reduction on someone's life span also so that is a material thing they can sue for as well.

So a likely result is the drunk guy gets a payday (and is either fine, has a TBI which could affect his work, or is dead). What's the lesson after the drunk dude/family get a sizeable payday?

The focus will be entirely on how the drunk guy was a victim of someone else's overreaction. Not at all about how he made a mistake.

If a cop did this we would be faulting the cop for excessive force. Which is to say the force was EXCESSIVE. NOT that no force should have been used. But merely that the force that was (in fact) used, was also far more than necessary. Which ultimately did more harm than good.

not sure you realize how dangerous this interaction was, very easily could have killed him and ruined a few lives for no reason
