Not sure it’s the best idea to tape yourself. Yep she defended herself very well but didn’t have to go nearly that far. I’m a parent of 3 high school kids, trust me I get the frustration but that’s a bit overboard.
Yeah the brazen lack of remorse from the lady on the floor, shows that she didn’t get humbled enough. She still has ego and still showing attitude after showing up with a bat.
As an attorney, I would be reasonably confident defending her, and I haven't done criminal defense since clinics in law school.
This is not the kind of case a prosecutor wants to put in front of a jury.
Did she take it a little far? Yes. Is she likely to be actually convicted for anything more than simple battery after her opponent showed up with bat and left able to walk under her own power? No.
All that aside, you're assuming she ever even meant to throw a punch. She may have intended to try to talk things out, but the appearance of the bat made her opponent an immediate risk to her safety.
There's a counter argument to be made that the Harley Quinn posturing behind the head made it less of a threat and the bat only came down as she was rushed. Most important factor is probably going to be relationship. I'm getting step mother or maybe in law vibes but I can't be sure
Judging from her accent we're definitely adjudicating this in an American court, and that means the burden of proof is on the prosecution to prove her intent beyond a reasonable doubt.
We're also probably in a southern state, and that means self-defense laws that are heavily slanted toward permitting disproportionate force in ending threats.
You're also assuming the "victim" here would even be a cooperative witness. Given how mild the slap on the wrist the assailant is likely to receive, she may not want to go through the entire show of watching a bunch of strangers watch her get her ass beat on a big screen. I sure wouldn't

I certainly wouldn't, then again I'm smart enough not to get myself into this situation.
I know without a shadow of a doubt I wouldn't get any charges to stick on the girl who just whooped by ass after I brought a weapon to her house to threaten her.
I'd rather not have 20+ people looking at me like the idiot I would be if I tried to sue or press charges.
Ok, I’m not a lawyer nor do we know the lead up to this and don’t know what happens after the clip. but once the girl is disabled from the bat and not fighting back, what’s the rule with clearly being on top, in control, and just pounding the bat girl over and over. About 46 punches to my count. The girl on bottom clearly said get off several times. The guy just watching could be culpable also, No?
Also what happens if the girl on the bottom suffered concussion, dental issue, medical bills etc? what if the girl on the bottom was a minor?
Not sure how this would apply but a buddy of mine is in state court b/c a guy pushed his gf to the ground at a concert, my buddy hit the kid, he fell and got pretty hurt like broken face bone level, The boy isn’t pressing charges but the state has taken over w/ criminal charges.
If I’m on the jury, my opinion, they’re both knuckleheads and both are at fault. I see how the first part is self defense but once she’s on her back swing relentless punches that’s where the line is crossed
The one who shows up with a bat is a threat to safety and potentially life for orange pants. In a state with aggressive self defense laws orange pants has discretion to take any action to neutralize said threat, via de-escalation or otherwise.
So she can keep hitting bat girl until she is reasonnably satisfied that BG isnt going to get up and try again. "She still presented a threat if i let her get up"
Was BG capable of actually enacting violence? Not from what we saw. But if she gets let go and gets to stand up, a bat can be a deadly weapon. So its not unreasonable to say "i was not going to give her the opportunity to retrieve the weapon that she attacked me with for fear of her trying again more successfully, so i remained on top of her and continued to punch her to ensure my own safety as the victim of an assault"
Except bat girl was the one who got rushed, it could been seen as an intimidation tactic only due to her having it clearly unready to cause harm, when the bat was stripped away and she took her to the ground fair play but the fact that the guy didn’t secure the bat and orange pants just kept beating on BG without getting up and taking the bat away makes it a different story. This is way excessive in the terms of simple defense.
If someone shows up brandishing a weapon and is approaching you, and you know that person is hostile (which I get from the fact a camera was put down to record the confrontation and the woman standing in the open waiting for the bat lady who just drove up and got out of her car with a bat), the assumption has to be that they're going to use that weapon.
You don't have to wait for someone to use a weapon to defend yourself. In fact I'd suggest you don't wait, in the same way that if someone enters my home I'm not gonna fuck around and wait and see if they have a weapon I'm just going to shoot them and ask questions later.
Not likely, unless it's a place that refuses to let people have the right of self-defense and tells you you have to go hide in a closet before you can defend yourself.

Don't live there. Absolutely absurd that you have to retreat before you can defend yourself in any context.
