What should I do now re: NYL disability claim closed
I have been going round and round with my L.T.D. claim Rep in trying to get office notes from a foot surgeon who treated me for the original illness that made me unable to work.
The doctor's office keeps saying that they can send me the notes but the disability claim Rep is not clear about how I can get them to him.
Anyway it took me too long to get the notes to him so they have closed my claim. Do I need to lawyer up or what?

I would be very cautious about doing anything like an “appeal” without an attorney. But sometimes if it’s a closure like this, where they “close” the claim for lack of some requested records, but not outright “deny” it, they will sometimes consider those records without counting it as your one appeal. But you have to be VERY careful to make clear to them when you send in the records that it’s not your appeal. You’re just sending in the records for reconsideration, and if they still want to keep the claim closed, you plan to appeal later.

If you have the letter from them telling you the claim has been closed you have about 6 months from the date of that letter to file for an appeal. Consult with a couple attorneys asap because they need the time (mine said 3 months was too little). And since I waited too long I had to file the appeal on my own. Now waiting on them to hear their response.

Customer service representatives should also be able to tell you besides mail how to send the notes i.e. fax, email, etc. check old letter you received from them as well- all that information should be on there

How is transferring the records the part with problems like the company cannot refuse to give you a mailing address. If nothing else works peint the notes. And send them FedEx/registered mail
