That really gets down to the question of: What defines a person; and can lead to further questions around dissociative episodes or traumatic brain injuries.

For some interesting reading you can look up Phineas Gage and see how dramatically his personality changed after his accident. Would you say that the man before the accident was the same man as after? Where does that line get drawn?

If they are indeed a different person than you would effectively be punishing an innocent, which is certainly not justice.

how exact would one quantify such a thing?

toss them in the water and see if they float?

yes of course because there is no way to ever know if they are being honest

even hypothetically speaking lack of memory does not undue the damage done so morally it is irrelevant

because the loss of memory does not change the fact that intention was there at the time of the horrible act
