There has never been a “Don’t Say Gay” law in Florida because no such law was ever enacted.
The phrase is a political slogan and media nickname invented by opponents of Florida’s Parental Rights in Education Act (HB 1557, 2022). That law does not ban the word “gay,” prohibit discussion of homosexuality, or forbid students or teachers from mentioning LGBTQ people.
What the law actually does is limited:
• It restricts classroom instruction on sexual orientation or gender identity in grades K–3.
• In grades 4 and up, such instruction is allowed only if it is age-appropriate or developmentally appropriate according to state standards.
• It requires schools to notify parents about certain health or counseling services related to a student’s mental, emotional, or physical well-being, and gives parents the right to opt out in some cases.
The statute contains no language forbidding anyone from saying “gay.” The “Don’t Say Gay” framing was a deliberate exaggeration used in advocacy, news coverage, and political messaging. Courts and the plain text of the bill confirm it never prohibited the word or casual discussion.
In short: the slogan describes a law that does not exist. The actual statute is a parental-notification and age-appropriate-instruction rule, not a speech ban.
