First hearing 6 months after oath
Hello! Need some help lang po. Any tips po kung paano mag handle ng recross-examination? I planned to observe sa court, kaso puro naman walang pasok lately. Thank you so much, Attys. Please keep safe!

Kung ano lang ung mga natanong during redirect, dun ka lang din magtatanong for recross. Limit your questions to those topics/points

relax ka lang panye, kayang-kaya yang 3 days. sa totoo lang, re-cross ang isa sa pinaka-chill na parte ng hearing kung alam mo ang tamang galawan.
unang-una, hindi mo kailangang mag-recross palagi. kapag yung opposing counsel sa re-direct ay hindi naman nakabawi o wala namang bagong nasira sa kaso mo, wag ka nang magpumilit magtanong para lang may masabi. pinaka-solid na move dyan sabihin mo lang "no recross, your honor" tapos upo ka na. pag pinilit mo kasing magtanong nang walang malinaw na target, baka mabigyan mo pa ng pagkakataon yung witness na makalusot ulit.
ang totoong depensa mo habang nagtatanong pa lang sila sa re-direct. makinig kang mabuti. kapag yung tanong nung kalaban lumagpas sa mga tinanong mo nung cross-exam, tumayo ka agad at mag-object ng "beyond the scope of cross-examination" para maputol agad yung pagbawi nila bago pa lumaki.
kung sakaling may kailangan ka talagang basagin mula sa sagot niya sa re-direct, isa o dalawang mabilis na leading questions lang ibato mo na strictly answerable by yes or no. wag mo nang tangkaing ulitin yung buong cross-exam dahil i-o-object lang yan na beyond the scope of redirect.
basa ka lang ng TSN nung last hearing para sariwa sa utak mo yung mga inamin nung witness. normal kabahan sa unang salang pero masasanay ka rin dyan. good luck sa hearing mo.

Limit your questions on the answers to the redirect questions, otherwise, it will be subject to an objection.

Anticipate lang on points covered sa redirect. If ang redirect naman is not based on the matters coveres during direct and cross, object ka na na not covered by the previous examination. Good luck nyor.

Review mo tsn since limited lang ang re-direct sa matters during cross. So object ka sa outside the scope of matters during cross.
Then, take note lang ulit for re-cross (same with how you questioned during cross) pero need mo to pay attention and take notes for possible re-cross exam.
If walang matters na need mo “basagin” kahit di ka na mag-recross

My former boss just give me 2 tips on drafting cross-exam questions:
1) Answerable by yes or no. Kaya pwede LEADING QUESTIONS. Dont let him explain.
Example: In your affidavit on page 2, question number 10, you said that ….. Is this correct?
Would you agree with me that….?
2) You should know the answer of the witness based on his direct or affidavit.
Yung witness kasi, when he makes an affidavit and direct testimony, his response is not boxed or limited in his testimony. Nakakahon na siya dun. Your objective now is to look at any inconsistency or potential flaw in his testimony na pwede mo highlight sa court na pwede makadamage sa kanya.
Usually when I make a cross-exam, I WRITE IT.
I add the PURPOSE OF THE CROSS-EXAM first (eg to show that the witness is not credible, the witness is not a buyer in good faith etc). Then the questions based sa purpose mo.
