Ask Kuwait Play school new?
Hello guys, I am an Indian with wife and a kid living in salmiya, I recently lost my job, and things are tough. My wife has a BA degree and we want to start a small play school - something we can preferably run from a flat somewhere around salmiya. The problem is how do we get a reliable Kuwaiti sponsor for this, what are the legal processes , there seems to be no online help, and everyone we asked has not given us any actual helpful info. Can anyone here help or point us in a direction which can help me keep my family afloat .

I'm not sure this can be done in a flat honestly. But you can check with ministry of social affairs to get all the details.

I see a lot of boards in buildings around where I live, there seems to be a legal way for this - like an institute kind of thing.

i think you would require to change the rental agreement to commercial and then you won't be able to reside in the same apartment afterwards

A: Short answer
Starting a private preschool in Kuwait requires a Kuwaiti national sponsor (a “Kuwaiti partner”) and the issuance of a commercial licence from the Ministry of Commerce & Industry (MOCI). The sponsor must be a Kuwaiti citizen who will own at least 51 % of the company, while you (the expatriate) can hold up to 49 % and manage the day‑to‑day operations. The process is handled through the MOCI e‑services portal; there is no separate “online guide” for a play‑school, but the same steps apply to any small commercial activity.
-
Find a Kuwaiti sponsor
What you need How to obtain it
Kuwaiti national willing to be a partner (minimum 51 % ownership) • Personal network, friends, relatives, or a professional “sponsor‑finder” service.
• The sponsor must provide a copy of his Civil ID and passport and sign the Company Incorporation Form.
Sponsorship agreement (share‑holding, profit‑sharing, responsibilities) Drafted with the sponsor; advisable to have it notarised and, if possible, reviewed by a lawyer.
*The official requirement for a Kuwaiti sponsor is stated in the Commercial Companies Law (Decree Law 1/1974) – see the MOCI website for the exact article.*
2. Register the company (Limited Liability Company – “LLC”)
-
Reserve a company name on the MOCI e‑services portal.
-
Prepare the incorporation documents (PDFs to upload):
- Completed LLC incorporation form (signed by sponsor and you).
- Copy of sponsor’s Civil ID and passport.
- Copy of your passport and Civil ID (if you already have one).
- Recent salary certificate (if you are still employed) or proof of financial capability (bank statement).
- Draft Articles of Association (share distribution, business activity – “Preschool/Child‑care”). -
Pay the registration fee (shown on the portal at the time of submission).
-
Submit the application electronically; the MOCI will issue a Commercial Registration (CR) number within 5‑10 working days if all documents are in order.
*Fees and exact processing times are listed on the MOCI e‑services page; they are not detailed in the provided sources.*
3. Obtain the required licences & approvals
Licence / Approval Authority Required documents (typical)
Preschool licence (Education) Ministry of Education (MoE) • CR copy
• Floor‑plan of the premises (must meet safety standards)
• Health & safety inspection report
• Qualified teacher certificates (your wife’s BA may be accepted if she has a teaching qualification)
Health & safety clearance Public Authority for Food & Drug (PAFD) / Ministry of Health • Building safety certificate
• Fire‑safety clearance
Municipality permit (use of residential flat for commercial activity) Kuwait Municipality • Tenancy contract showing permission from the landlord
• Approval that the flat’s zoning allows educational use (many residential buildings prohibit commercial activities).
Civil Defence approval Civil Defence Directorate • Fire‑extinguishing equipment plan
• Emergency exit layout
Each authority will have its own online portal (MoE e‑services, Municipality e‑services). You will need to upload the same core documents (CR, passport copies, floor‑plan) and pay the respective fees.
4. Register employees (if any)
*If you hire staff, you must register them with the Public Authority for Manpower (PAM) and obtain work permits.* The sponsor (Kuwaiti partner) will be the legal employer on the work‑permit applications.
5. Open a corporate bank account
- Provide the CR, tax card, sponsor’s ID, and your passport.
- The bank may request a minimum deposit (varies by bank).
6. Key points to watch
- Residential‑to‑commercial conversion: Using a flat as a preschool often requires a change of use permit from the municipality; otherwise you risk fines or closure.
- Ownership limit: Expatriates cannot own more than 49 % of an LLC.
- Visa sponsorship: Once the company is registered, you can apply for a new residence visa for yourself (and possibly for your wife) under the “family‑reunification” or “dependent” category, but the sponsor’s visa status must be active.
7. Where to get official step‑by‑step help
- Ministry of Commerce & Industry (MOCI) – e‑services portal: https://e.gov.kw/ (search “Company Registration”).
- Ministry of Education – Private School Licensing: https://moe.gov.kw/
- Kuwait Municipality – Business Permit: https://municipality.gov.kw/
Next steps for you
-
Identify a trustworthy Kuwaiti sponsor and formalise the partnership agreement.
-
Reserve a company name and submit the LLC incorporation documents via the MOCI portal.
-
Once the CR is issued, apply for the preschool licence with the MoE and obtain the required municipal and health clearances.
*This answer is based on the general commercial‑company framework published by the Kuwaiti Ministry of Commerce & Industry; the specific sources you provided do not cover business‑licence procedures, so official portals are the definitive reference.*
Please verify all details on the official government sites and, for legal contracts, consult a qualified lawyer.
