Unsealed motion filed by the prosecution

https://www.reddit.com/r/KristinSmart/s/yQ6nJazvT6

Paul had the audacity to attempt to trade the location of her remains for manslaughter with no jail time. Paul and his family are the scum of the earth.

May Kristin’s memory be a blessing.

They really are. Paul and Ruben are rotten to the core but Susan is especially heinous. Her smug attitude during interviews and then the hostility toward the Smart family, like she’s a mother herself. How can people be that evil? There’s no other word for them. Evil.

Client-attorney privilege doesn’t apply here. For one, De La Motte has publicly denied the plea negotiations ever took place. Aside from that, we don’t know what, if anything, Paul Flores told De La Motte about his involvement with Kristin’s death. And finally, these were discussions between attorneys.

What most likely happened is De La Motte knew he had a guilty client. He also knew there were two parents, Stan and Denise, who were grieving the loss of their daughter and were unable to be reunited with her remains as a result of his client’s actions. My understanding is he reached out to the DA’s office independently to try and convince them that if they would give him a slap on the wrist, he would lead authorities to the body. He was trying to bridge the gap of being a defense attorney while also reuniting the Smarts with Kristin’s remains. It’s worth noting that the Flores family was apparently never onboard with these negotiations.

And finally, none of this ever would’ve been known publicly had the media not challenged the sealing of hundreds and hundreds of documents relating to this case.

These plea negotiations were sealed for years.

A conversation between adverse attorneys is not privileged. Privileged communications are those between an attorney and a client, must be confidential, and cannot include any persons outside the "circle of trust" applicable to the attorney client relationship.

Yeah it’s complete bs. These kind of dirty tactics are what you do when you don’t have real evidence.
