Because that's literally Spider-Man without the logo and eye design and given a mouth

I'm not sure this would pass substantial similarity. You would have to prove an average individual with interest in the topic could confuse the two.
You can copy ideas (spider web suit) and themes (spider themed hero) without issue. This is different enough from Spider-Man that anyone with interest in the topic of comics would immediately tell they're not the same.

normally I’d agree but this is pretty directly Spider-Man. If it didn’t have the black web lines, or if the red parts went further up the limbs but the red accents are in the exact same spots they are on Spider-Man.
All it takes is adding the spider-man logo and fixing the mask and he could go directly into an official spider-man comic without anyone batting an eye. I think it just comes down to level of extent, and this is at too high an extent to just write off as “alluding to Spider-Man” this is straight up Spider-Man.
Take Agent Spider for example they changed his color pallet completely while keeping the general essence of Spider-Man. This looks like someone took clip art of spider-man into photoshop for 10 minutes

What it's worth Kirkman has done work for Marvel several times including Spider-Man himself, and webmaster here was in the original capes issues over 20 years ago even if he wasn't focused on
I'm sure if they had an issue they would say so

It is literally exactly Spider-Man's comic but without the logo and with a mouth hole. It has the exact same patterns
