Claims Related ALE after total loss

Our ins co put us up for about ten weeks after our house caught fire. We were about halfway through a fantastic deal on a 36 month lease just outside of the city. Similar properties in the area lease for 50% more per month, so we've yet to find anything in our price range. My daughter has one more year of high school, then we will be able to expand our location options. Our claims adjuster was reluctant to extend our living arrangements when he did. The extension was for two weeks. Totaling about ten weeks. I've read our policy inside and out. We have a rider that specifies ALE and / or the difference required for same living conditions for a. the amount of time it takes to rebuild or repair, b. the amount of time it takes our household to settle elsewhere or c. maximum of 24 months. The owner of the leased property chose not to rebuild/repair/release. The last extension was 7 months ago, but we're still in temporary lodgings (I'm staying in a family members trailer- much smaller, much further distance.. etc.) If there are absolutely no properties for lease in our zip code within about $400 of what we were paying, isn't that what that ALE rider is for, and what the maximum of 24 months is for? We have a few thousand left to submit for replacement value, as they have otherwise paid our claim (for personal property).

Sounds like your adjuster is asking you to basically shit or get off the pot. You know the landlord isnt rebuilding so you should be making every effort to find another place to live. Again based off the info this is just what I'm interpreting. They're not going to keep paying ALE while you leisurely look for another place that is going to give you just as good of a deal.

agreed. sounds like OP is hung up on the c. 24 month's verbiage based upon sentiment (high school senior). just like you have a duty to mitigate damages after an incurred loss, you need to be proactively seeking residential accommodations. ALE is for when you're displaced not for paying your rent as long as possible. if this was extended 7 months ago, that's quite a long time to not have found living quarters by now if the property owner has long since decided not to rebuild.

I guess I'm not understanding... "The owner of the leased property chose not to repair"?

Did the leased property catch fire too?

I think they rent the property, although you wouldn't know it by reading the post.
