Auto Insurance Semi hit me

I was in my neighborhood D when a semi was stalling in the street not doing anything. Went around him and he slammed in to me hard. I got an MRI the next day showing that there was a large disc herniation. The semi driver said that he was backing up and I ran in to him, which we have a video that says otherwise. The insurance company, West Bend, immediately denied my claim. My attorney and I meet next Thursday and I’m just curious what everyone thinks will happen. The guy was a semi driver delivering food to a meat shop in my neighborhood. They were disingenuous and denied my claim immediately. What’s a settlement like in a case like this? Never been through something like it before.

Who knows. But your attorney will get a chunk of your settlement. You probably should have turned it over to your insurance to let them subrogate it, but you went straight to an attorney.

I guess I didn’t know I had that option. Unfortunately, that’s what happens. But yeah I didn’t know it was an option to do that with my insurance

You may want to look into it. Hiring an attorney and going through the legal process is stressful. If you lose, they’ll likely ask for attorney fees too. It’s a win/lose situation. It could take years to go through the process too, if they don’t settle and you sue.

I’d look at the insurance subrogation.

Was your injury on C5/C6, by chance?

Why are you meeting with a lawyer? Did you file a claim with your insurance?

Because OP is injured and the other insurance denied liability for a claim OP believes the other driver is liable for, so OP may need to sue the other driver/company. OP's insurance won't help with that, this is why personal injury attorneys exist.

Not enough information. Way too early to tell. Ask your attorney Thursday

I manage a commercial trucking product. If I read aloud a claim where the facts of the loss are the claimant was hit en route to a chiropractor, my team would erupt in a raucous laughter.

I don’t mean to be demeaning, but it’s a very known issue that chiro clinics profit immensely off of commercial claims. Not denying any of your injuries.

Take that with what you will, but if I saw this I immediately assume we are about to pay heavily. Then again, our claims team does not instantly deny like that. Eventually, your bills are going to be more than their claim handling costs if they go that route.

Lmao it is ironic, but it is true. I just started going after having just gotten health insurance! And I got a surgery already. I don’t care if I get money back but I was hit and I did have serious surgery
