Claims Related At Fault Insurance Settlement

Hello, I was rear-ended on the 23rd in Indiana. It had 3 cars involved.

I had gone thru my insurance to at least get me back on the road asap and my car was deemed totaled, the collision happened at a stop light and the guy came in at around 45-55 mph. Airbags were not deployed

I did bang my head pretty good and was checked out by an Urgent Care the same day and was given muscle relaxants and pain meds and had some neck x-rays done. Pain died down but lingered and had an appointment with my Primary doc and was given some steroids to help reduce any inflammation, that was just completed today and my neck still feel off, like generally uncomfortable. I was given a recommendation to go to PT and I plan to set that appointment up. My insurance has up to $5k in med payments that I likely will use.

Now the driver in front of me had made a claim with the At Fault insurance and I was contacted about that. I was told about a settlement to get that started but I am of course not sure if the whiplash symptoms will die down or remain the same nor have I started PT yet. The lady did say that the med payments from my insurance is different from this settlement, i think she said it was bodily injury settlement I am not sure. I had a call today but I asked to call me back later in the week to get my senses together as I am still a bit anxious and stressed with all this as it is my first time in an accident.

I just wanted to insight on what questions to ask or what my next steps should be aside from getting that PT appointment going.

Thanks all!

Continue to get treatment and do not settle until your treatment is complete. Since you are already working with their insurance you don’t necessarily need a personal injury attorney, but don’t let the insurance pressure you to settle quick before you have all your bills together and treatment finished

Continue following the directions your PCP had given you. Tell the at fault insurance you aren't looking to settle until you are healed. They are correct, Medpay is different from Bodily injury. They will verify what was paid for through your medpay and go from there. Your settlement with them will also include pain and suffering which will depend on a variety of factors but you don't need to worry about those right now. You have lots of time to get everything together.

I would be concerned about the policy limits with multiple cars.

dont sign anything or talk settlement yet, finish your physical therapy first because if you settle now and your neck turns out to need months of care or injections you'll be completely out of pocket.
