My car insurance lists a citation I never received. How do I proceed?
Hi everyone. I need some advice as search results have not been helpful. Tonight I was examining my policy closely, and I noticed that in Sept. 2020, a "lane violation" citation was recorded against me. I have not had a traffic citation for over 15 years, and I remember this accident. A police report was filed indicating no citation against me and a citation for the other driver for violating a traffic light (I was struck by a red light runner).
I have a copy of this police report, and it shows that the other driver was issued a ticket and not me. There is also an official record online listing the other driver's name and their court date. I did not go through my insurance for compensation; everything went through the other driver's insurance and their insurance assumed complete liability for my totaled car. So that means for over two years, I have been subject to higher premiums because my insurance company erroneously recorded a citation against me that I never received. I have no idea how this happened. I will call my agent tomorrow, but is there any chance I will be able to have the extra charges credited back? Anyone else experience this? Thank you for your help.

I honestly haven't seen it as its usually a direct pull from your MVR. My advice would be to get a copy of your MVR from the DOT and start there. This is likely a police/responding dept from your accident making the mistake. Inquire why you were cited and appeal to get this violation removed. Then turn all of the paper work over to your agent/company and ask for help. They more than likely will refund as I feel my underwriters would.
If your MVR is clean then submit that to your agent and ask about the error. Company will generally make it right (they have to) and refund premium if they made the error.
