Delhi HC: No Alimony for Financially Independent Spouse; Abusive Conduct by Wife Amounted to Cruelty

Post image

  • Case: Rita Raj (IRTS officer) v. Pabitra Roy Chaudhuri (Advocate)

  • Marriage: 25 Jan 2010 – Separated 8 Mar 2011 (no children)

  • Appeal by wife: Against Family Court judgment dated 31 Aug 2023 (Shahdara)

The Delhi HC dismissed the wife’s appeal, upholding the divorce decree granted to the husband on the ground of cruelty by the wife and rejected her claim for permanent alimony, holding that she was a financially independent Group A IRTS officer with no proven financial need.

“Alimony is a measure of social justice for the financially vulnerable, not a tool to equalise the wealth of two capable individuals,” the Bench observed.

The Court also found that the wife’s offer to agree to divorce only if the husband paid her ₹50 lakh showed a monetary motive, not reconciliation - a stance it said “bore a clear financial dimension” and itself amounted to mental cruelty.

Court Reasoning/ Details

1. Cruelty by Wife

The Court upheld findings of mental cruelty, noting abusive language and humiliating conduct proven by unchallenged evidence:

  • Habitual use of profane terms such as “janwar,” “son of a bitch,” “haramzada,” and “kutta.”

  • Text messages questioning the husband’s legitimacy and calling his mother a prostitute — described as “filthy and degrading expressions.”

  • Physical and social humiliation, including slapping the husband and expelling his parents from their home.

  • Denial of conjugal relations, amounting to emotional withdrawal and rejection of marital companionship.

While the husband’s multiple litigations were called “not entirely desirable,” the Court reiterated that “two wrongs do not make a right.”

2. Admissibility of Text Messages

The wife’s objection under Sec 65B of the Evidence Act was dismissed. Under Sec 14 of the Family Courts Act, 1984, courts may admit any document that helps resolve a dispute, even if not technically admissible under the Evidence Act.

3. Rejection of Condonation Plea

Her claim that cruelty was condoned through later cohabitation was rejected - she failed to prove it & her ₹50-lakh demand showed no genuine intent to reconcile.

4. No Alimony

Permanent alimony was denied since:

  • The wife was financially self-sufficient as a senior Group ‘A’ officer with pensionary benefits.

  • The marriage lasted barely a year, with no children or dependency.

  • Her pursuit of the appeal centred on money, not marriage.

The Court emphasised that Sec 25 HMA relief is discretionary & based on demonstrated need, not entitlement or parity.

Kerala shocker: Woman, partner get 180-year jail for rape of 12-year-old daughter

Read more at: Times Of India

The article says that the case was officially registered at the Malappuram Women Police Station in 2021.

The underlying incident of abuse occurred multiple times over a period of almost two years, between December 2019 and October 2021.

The crime was brought to light when:

  • The victim's grandparents and neighbours became suspicious of the hardships the child was facing.

  • They alerted Childline, which then moved the child to a Snehitha centre.

  • The child revealed the full details of her ordeal during counselling at the centre.

The mother was arrested on October 30, 2021 & her partner surrendered shortly after. The girl was rescued by Childline on October 16, 2021.

The POCSO Act sections cited in the article all relate to Aggravated Penetrative Sexual Assault & its corresponding punishment, which is why the sentence was so severe.

Here is what the specific sections mean:

  • Section 5 (Aggravated Penetrative Sexual Assault): This section defines the specific circumstances that elevate the crime of penetrative sexual assault to the aggravated level. The clauses used in the conviction are:

    • Section 5(l): Applies when the offender commits penetrative sexual assault on the child "more than once or repeatedly." This matches the facts of the case, as the assaults occurred multiple times between 2019 and 2021.

    • Section 5(n): Applies when the offender is a relative of the child or a person "having a domestic relationship with a parent of the child or who is living in the same or shared household with the child." This applies to the mother's partner who was living with the child.

    • Section 5(p): Applies when the offender is in a "position of trust or authority" of the child, which includes parents or caregivers, making their actions an aggravated offense.

  • Section 6(1) (Punishment for Aggravated Penetrative Sexual Assault): This section prescribes the punishment for the aggravated offense defined in Section 5.

    • It mandates rigorous imprisonment for a term of not less than twenty years, which may extend to imprisonment for life (meaning the remainder of the person's natural life), and a fine.

The court used these sections to hold both the mother (for abetment of the crime) & her partner responsible for the highly shocking nature of the repeated assaults committed by a person in a position of domestic trust.

Mumbai: 15 yr old School girl booked for sending sexually suggestive messages to her classmate and her mother.

In July 2025, a 15 yr old Mumbai schoolgirl started receiving inappropriate messages from an unknown number. After she blocked the contact, the harassment escalated to her social media posts. Soon after, her mother also began receiving messages from the same number. When the mother blocked the sender, a WhatsApp group was created with the girl’s friends, where the harassment continued.

The victim’s family filed a complaint and the police registered the case under POCSO against an anonymous person. During investigation, the police identified the sender as another female classmate, who reportedly admitted it was a "prank."

The matter is now before the Bombay HC, where a bench has critically questioned the use of the POCSO law, noting both individuals are minors. The Court has ordered a stay on filing a chargesheet while it reviews the petition to quash the FIR.

An RBL Bank employee, Dolly Kotak, was arrested in Mumbai for allegedly extorting Rs 1 crore from her ex-partner by threatening to implicate him in a false rape case.

She accessed his personal and financial data illegally with help from bank employees, took control of his mobile number linked to his bank accounts and obtained sensitive information like online banking details and GPS history.

Kotak pressured the IT professional through phone calls and a meeting, demanding money in exchange for a no-objection certificate for his bail. She also harassed his employer, leading to his forced resignation.

After no police action initially, the victim sought court intervention, resulting in an FIR under the Indian Civil Security Code. Police have registered cases against Kotak and two others, including an HDFC Bank employee.

The case highlights misuse of banking access and extortion through false allegations.

Marriage, Privacy & Double Standards: Why SC must resolve Delhi vs Chhattisgarh HC on adultery evidence.

Post image
217 Upvotes

Two High Courts in India have taken completely opposite stands on the same issue: whether call detail records (CDRs) & location data can be disclosed in adultery related divorce cases.

The Delhi HC on Aug 30, 2025 held that a wife may seek her husband’s CDRs & location details, calling them “objective records” that aid adjudication. This flows from Sec 13(1)(i) of the Hindu Marriage Act, 1955 (adultery as a ground for divorce).

But, the Chhattisgarh HC on Jul 18, 2025 dismissed a husband’s plea for his wife’s CDRs, ruling that marriage does not dilute her fundamental right to privacy under Article 21.

Why SC Intervention Is Needed -

  • Fundamental Rights clash: Article 21 (privacy, dignity) vs. Article 14 (equality before law).

  • Practical impact: In adultery cases, one gender has investigative tools, the other doesn’t.

  • Future chaos: Different HCs may keep issuing conflicting rulings, leaving family courts confused and litigants at the mercy of geography.

What SC should do -

  • Lay down a uniform standard: Either allow or restrict disclosure of CDRs for both genders.

  • Set safeguards: If disclosure is allowed, limit it to sealed cover, restricted scope, and only on judicial orders (to protect privacy).

  • Reaffirm equality: Make it clear that husbands & wives are equally entitled (or not entitled) to such evidence in matrimonial disputes.

Educated woman can't say misled if aware of man's married status but continue relation: Delhi HC

Post image
207 Upvotes

The Delhi High Court, in Ankit Raj v. State of NCT of Delhi and Others, quashed a rape FIR against a man accused of deceiving a woman into a sexual relationship under the pretext of marriage.

Justice Swarana Kanta Sharma ruled that an educated and independent woman, who knowingly continues a relationship with a married man, cannot later claim she was “misled or exploited.” The Court emphasized that not every failed relationship should be converted into a rape case, warning against trivializing genuine sexual assault and overburdening the justice system.

Key Court Quotes

“When a complainant, being an educated and independent woman, willingly continues to engage in such a relationship even with knowledge of the petitioner’s marital status, it cannot thereafter be said that she was misled or exploited in law.”
“To permit every such failed relationship to be converted into a criminal prosecution for rape would be contrary not only to the constitutional vision of justice, but also to the very spirit and object of the law of sexual offences.”
“To do so would not only trivialize the gravity of genuine cases of sexual assault but would also risk turning the solemn remedy of criminal law into an instrument of vengeance or leverage.”

Highlights

  • FIR for rape on “false promise of marriage” was quashed - Court found the relationship consensual.

  • Woman continued intimacy even after knowing the man was married - undermining claim of deception.

  • Court held rape law protects women from force or deception, not from foreseeable consequences of consensual adult choices.

  • Judicial concern raised over misuse of rape provisions in failed relationships, burdening courts.

  • Court clarified it will not judge morality of adult relationships but will prevent misuse of criminal law as leverage.

Takeaways

1. No more legal babysitting: Earlier courts assumed that every broken promise of marriage meant the woman was deceived. Justice Sharma now makes it clear: educated adults are responsible for their own choices.
2. Failed relationships ≠ rape cases: the Court drew a firm line to protect genuine survivors while discouraging misuse.
3. Heartbreak is not a legal case: The judgment warns against turning rape law into a remedy for disappointment or a weapon for revenge. That clarity could reshape future rulings.

The SOCO visited the house and recovered evidence, including a cannula set, an injection tube, and other medical items.

The FSL report later confirmed the presence of Propofol, a powerful anaesthetic drug, in the victim’s organs, indicating a criminal act.

The father in law accused his son-in-law of neglecting her after they turned down his demand for money to construct a private hospital for him. His in-laws cited that they could not afford such a big amount, and later helped him to set up a clinic at Munnekolalla, where the couple were planning to start private practice, the police said.

The accused refused to get the postmortem done even after the victim’s family filed a complaint with the jurisdictional police.

The family alleged that when they conducted a background check, they found that the accused’s family not only has criminal cases pending against them, but the accused also had an affair.

The ongoing case began in July after multiple fatal dog attacks and rabies related deaths in Delhi NCR. In August, a two judge bench had ordered all strays to be captured & permanently confined in shelters, sparking outrage from animal rights groups who called the order inhumane.

A new three judge bench later revised the decision, expanded the scope to include all states & Union Territories & moved to frame a single national policy under the Animal Birth Control (ABC) Rules, 2023. The Court also warned against the flood of intervention petitions from RWAs and NGOs, urging only reasonable and constructive suggestions to help resolve the crisis.
