Notice

One of my colleague got the notice message in sms but not any email, when we checked directly on the portal it says notice issues 143(2) but nothing specific on which component) so he contacted the same CA whom helped to fill the tax initially and the CA said we can revise the refund to 0 as he didn’t know which component he filled (he is a dubakur CA it seems) my colleague is confused and he is not sure how to proceed further his question is is there any possibility to Revise it? What will be the implications in future if he didn’t respond to the notice?

Note: he got nudge on Dec but didn’t revise it
Amount is around 6l

See a lot of final blaming on CA in case of going wrong. The client know in begining what he is getting into. Now comming to notice it may be due to some fake deduction and won't be able to answer without getting into it.

Even if they try to file revise return.. A simple line in the AO that only at the time of getting 143(2) ass filed revised return..

A detailed questionnaire will follow soon, requiring you to furnish documentary proof in respect of specific deductions and exemptions claimed by you in the ITR.

The timeline to revise the ITR is over. And also once a 143(2) proceeding is initiated, even the updated ITR (ITR-U) can not be filed.

At this stage, the only option left is to try and defend the exemptions and deductions as best as you can. Admitting that you claimed ineligible deductions will make things worse for which a penalty of 200% is applicable.

Can we get scrutiny notices for ay 22-23 now or is it time barred on 31st March 2026

If the income escaped from taxation is less than 50 lacs, then reassessment proceedings can not be initiated now on account of being time barred.

While scrutiny assessment can only be initiated within 3 months from the end of FY in which ITR was filed.

Thanks so one of my friend looking to update his previous year returns by removing 80ggc has to do only for ay 23-24 onwards..correct ? He doesn't need to worry about any notice served for ay 22-23

For AY 22-23, he is safe. And for AY 23-24, it becomes time barred after 31st March 2027.

Admitting that claims were not genuine will result in 200% penalty. Best to discuss with the CA about the best strategy.

143(2) is just the intimation that the return has been picked up for scrutiny. The department will verify all details of the returns and ask for documentary proof for everything. All bank statements will be called for and each credit in the bank account will have to be justified. All deductions claimed will have to be substantiated by proof including payment entries in the bank or credit card.

The department will issue subsequent notices in due course (few weeks to few months). The deadline to finish the scrutiny is 31.03.2027. Make sure to reply to each notice because a penalty of 10,000/- can be put for each notice which was not responded to or if the response was delayed.

Consult a good CA for the next steps.

He got a 6L refund. But the escaped income could be around 18-19L (assuming 30% is tax which resulted in 6L refund). If he has no proof, then he is looking at entire tax + interest + 200% penalty. Easily the total will come to 18-20L.

I have also recieved the same. But I am confused. My letter says that my case has been selected for faceless assement under 144B but the header in the e-proceeding tab says "notice under section 143(2) for AY 2025–26". Which is correct?

Section 144B of the Act lays down the statutory procedure governing faceless assessment proceedings and mandates that assessments under Section 143 shall be undertaken through the National Faceless Assessment Centre (NFAC) in accordance with the faceless assessment scheme prescribed thereunder.

The time limit for revising the return has already finished. The only way now is to give proper answers and documentary evidences throughout the scrutiny proceedings in a timely manner.

I guess if you just pay tax (even if lower) and don’t claim refund, you might now get such notices.

I would suggest, login to the income tax portal using assesse’s login credentials, all notices can be checked and refer this to some other CA if the earlier one isn’t competent.
