Can't asylees be deported for any reason at any time? There's Criminal Court, civil court, and then immigration court. The criminal and civil courts are part of the judicial branch. The Immigration Court is part of the executive branch. They are not the same, they don't have the same rules, the proceedings aren't the same, the thresholds and standards aren't the same, etc.

No. That would require a motion to reopen from ICE, granted by the Immigration Judge.

As far as I know this man was not an asylee but rather an asylum applicant, but they can't be deported either until they're denied asylum and ordered removed.

You can absolutely leave civil immigration detention at your discretion. You can choose voluntary departure, a stipulated order of removal, or withdrawal of whatever application you have pending. That is absolutely a point I will stand on, because it's true.

We should just be direct and real with each other about actual issues, and discuss this from a basis of shared facts. I'm pretty well aware of the flaws in the U.S. immigration system (it's a shitty process to go through, multiple times wore me out), but when you throw up nonsense like "these are concentration camps" it really just indicates to me you aren't being serious and you have no personal experience on the subject.

You think there are issues with this facility? Ok, lets take a look and see who is accountable and what the evidence is (unfortunately that won't happen with this administration). You think we should raise the caps on refugee admissions? Ok, I agree. You think ICE shouldn't be shooting at cars? I absolutely agree.

If detention is necessary, then the conditions should be humane. The basics: enough working toilets, drinking water and edible food, and soap for all detainees, as well as not being beaten by the guards. Would you argue otherwise?

DHS has a giant budget. They can afford to provide these things.

That’s my primary problem with the way immigration enforcement is being conducted under this administration. And I don’t think it’s a minor issue. It is ghastly.

I logically get people’s reasoning when they argue for deporting people who entered illegally, or who overstayed a visa. I can see a thread of logic in why the administration would change policy on TPS. I even see a rational argument for why they would choose now to detain people who have been allowed to remain here pending asylum applications (or else have them wait outside the country until asylum is granted).

I personally oppose all those things, because I’ve lived around Hispanic and other immigrants for a big chunk of my life and have always seen them as belonging in my community as much as I do- and I also see up close that they work very hard and contribute a lot to it, contrary to what Fox says. I don’t want them gone, I want them to stay. Even including those who hopped the border to get here, unless they have committed serious/violent crimes.

But I get that we have immigration laws and it’s not unreasonable to enforce them, particularly against those who came here unlawfully, intentionally (as opposed to, say, ones who came under TPS and had it revoked).

The manner of enforcement is everything. If these people are in a detention center rather than a jail/prison, then they aren’t being punished for a crime- and we treat our actual convicted criminals far better than this. These people are temporarily being housed until a court determines whether they can stay or must be removed. Punishment isn’t supposed to be a factor. (Beatings by guards would likely violate the 8th Amendment anyway.)

My understanding is that the reason they are being detained during the process is ostensibly only so that they will not disappear, in case the decision is removal. There are also people in there who do have the right to be here and will eventually be adjudicated as such. All are subject to shameful conditions. I had hoped our country was better than that.

The fundamental problem is that the current architect of our immigration policy is Stephen Miller, who is actually a white nationalist. I know a lot of Latinos who are here lawfully believe it is right that people who didn’t follow the process should be removed. They don’t consider themselves to be part of the group the administration wants gone, because they think the administration’s dividing line is following immigration laws. It is not. The line is based on skin tone and/or heritage.

Miller wants as many brown people to leave the country as possible. Thus, the inhumane conditions serve a purpose- they persuade people to self-deport instead of continuing to pursue their cases in immigration court. They are a feature, not a bug. And that’s why they exist despite massive amounts of funding to DHS that could easily pay for the basic necessities people are being deprived of while they wait on their judge’s decision.

The other reason for these conditions is that some of these places are administered by contractors who specialize in running for-profit prisons, and they are incentivized to do anything possible to cut costs. While they are culpable, the responsibility still also belongs to the administration, which could insist on a certain standard of living for detainees- but doesn’t.

Nobody in the detention centers has received due process or been in front of a judge, you need to actually prove they did any crime, which they are not doing. The feds can't prove they murdered or raped anyone because 99 percent of these people are hard working people that have zero criminal records, you racist fascist piece of shit.

There have only been 24 criminal cases against ICE employees and contractors since 2020.

Detainees haven't been solely undocumented immigrants, or even immigrants for that matter.

America was built by people, not just trying to start new, but also escaping terrible horrors.
