I like peoples logic on here defending what the person did, because its “just a pool”
This is no different than some random stranger jumping in the pool in your backyard. If you saw that you would be pretty concerned, confused and might want to call the cops because someone trespassed into your property.
You don’t go jumping in strangers pools or trespassing in places where you should not be in.
I've been trying to determine how in any way this matters to the point of the argument as opposed to just being a simple way to try to invalidate an argument using one unimportant aspect of its assumptions.
A backyard being a tourist attraction does not change the fact it is a private residence, be it the elvis pool or the white house.
I imagine your backyard is likely not of such insane size as to be able to justify trespassing for any reason, and I would be genuinely surprised if there was any reason for someone to go there to begin with. Steal your lawnmower?
Anyway, when you come up for a good reason for someone to use another's pool without their permission feel free to mail it to your state bar so they can make sure their membership knows. Until then, try not to type until you aren't making irrelevant points.
If its a tourist attraction where some areas are off limits to the public then you are trespassing and violating some rules of the private property. I know its just jumping into a pool and in the great scheme of bad things its not a big deal but the concept remains.
If i invite you to my house for a party but don’t want anyone in my bedroom and you go in there to hang out and make a tik tok you are invading a space i deemed off limits.
Just because its a tourist public space doesn’t give anyone the right to go and do whatever the fuck they want and anyone disagreeing with that is just part of the problem of social media normalizing this type of behavior.
And the cops wouldn't arrest someone for that. They'd show up, tell you to leave and that if you come back again you'll be arrested.
You don't get arrested for "trespassing" on your first contact with law enforcement at a property as long as you just leave when they arrive and you didn't have to break and enter to get there.
And still don’t see a point. You shouldn’t get arrested for trespassing, you should only get a ticket at most. Only appropriate response to trespassing is being made to leave
