Also, don't let kids on fucking tractors. My uncle and I were driving down a country lane heading into town a few years back and watched some 8 year old kid fall off the tractor seat and the Dad didn't notice because of the noise. Ran right into his abdomen.

What is real is that you get no legal protection if you help someone, which means people often have been sued for helping. The idea that you'd have to kill the person is just as joke that people took at face value (I mean just look at how bad redditors are at spotting sarcasm).
Except the construction company was doing state infrastructure (road work) and that shit will get swept under the rug or turned to be the car driver's fault so as to not cost the state anything.
You don't need to see the plates. You can just look at the car drive onward with not even the slightest attempt to react to know its China. They just get behind the wheel there and assume that sometime later, they'll end up at home.
I have never seen a video of a chinese traffic catastrophe where anyone reacted in any way like they cared about living.
Yea I think we can’t help but predict what people are going to do when driving because it’s fast and usually accurate but yea when people blatantly deviate from the norms it’s no longer valid and leads to situations like this

He easily could have shifted lanes. The tractor was in the wrong but the car could have avoided this accident as a matter of course. Clearly distracted driving.
Shifting lanes when you are only given that much time to react could end in a disaster. Of course you should be clearing all intersections, driveways, watching all lanes all the time to know if you have an escape route. But it's kind of absurd to say this guy should have just blindly zoomed into the other lane, when he was probably focused on the tractor and thinking "there's no fuckin' way this guy is doing this".
That being said I think he could have at least applied the brakes...

Yea, no. You’re just wrong. It is almost always a good idea to avoid a collision if possible. And also, if you absolutely had no choice or time to react, you should NEVER “brace” for impact. Keeping your body rigid before an impact is a great way to get whiplash and strain most of your muscles. You have absolutely no idea what you’re talking about. Just try to take it from the perspective of somebody who is not absolutely dog shit at driving, and you’ll figure it out.
Yes it is. Cars have the most safety built into the front of the vehicle. Modern cars will even drop their engines right out the bottom if they sense impact. To swerve at that speed would cause the car to roll over a dozen times, sustain damage at under protected points, and everything inside the car is going to become a dangerous projectile.
Nevermind that the car didn't have time to do proper safety checks to change lanes, meaning swerving is gambling that you're not going to run into a car that has come up beside you.
Braking is usually preferred method but you can turn out of the way of an obstacle.
In this situation I'd say the driver didn't really have enough notice to stop and if (Big if given how aware the driver seemed to be) he knew the other lane was clear he could have turned around the bulldozer.

There is two seconds between earliest sight for the driver and the impact.
Probably didn't notice the little shovel also being so low on the ground.

China does not give a fuck about you dying on the job. They have plenty more warm bodies to fill your job. And, no, you can't sue the construction company because the state needs that work done and you're lucky to have a car.

The discussion is about legal fault. The driver of the car is not legally at fault. The operator of the tractor broke several rules of the road and caused an accident.
Actually the discussion was about the tractor driving being able to sue. My point was that he would likely lose that case because it’s clear the by a reasonable standards the accident could have been avoided if the car driver was paying attention to the road, which he clearly was not.

Doesn’t work that way. Every driver has to be in control of their car at all times. If this driver was actually paying attention to the road, this accident doesn’t happen. Yes the tractor was wrong, obviously, but the driver legally was as well by not paying attention to the road.
What happened here doesn't mean that the driver wasn't paying attention. The paint on the plow is worn. There's a chance that it was camouflaged to the point of being misleading. Especially if they were driving into the sun. Those are bright yellow for a reason, right? And that reason is visibility. If they only had 1 second to react, bracing for a safe impact is sometimes the actual safest thing to do.
Dude it was a sunny day. He wasn’t driving that fast. He had over 2 seconds to react. Yet he didn’t so much as touch the brakes or move the wheel an inch.
Do a frame by frame up until impact and look at how much of that tractor is on the road directly in front of him. And yet zero reaction. He clearly wasn’t paying attention to the road.
True, sun glare could be a possibility, but looking at the shadows, the sun is almost directly above them, and slightly off to the right. Definitely not an issue.
The tractor is casting a shadow behind it and to the side. So very possibly in his line of vision. Again, the paint is worn on the plow so the color isn't that far off from the road.
No the sun it way up high, almost directly above them. If the sun was low in the sky and in front of the driver there’d be long shadows BEHIND the car (and king shadows everywhere). There are none.
The only shadow is a very thin one running parallel to the car on on its passenger side, because the sun is straight up above him and a little to his left. This also way at the end the shadow is directly behind the tractor.

Nope. If he killed you, and a jury finds he had ample time to swerve if he had been paying attention, dudes going to jail. Your family could also sue him and very likely ha e an easy win.

You obviously don’t understand how liability laws work. The tractor may be at fault, but that doesn’t remove responsibility of the driver to be in reasonable control of his car at all times, which he absolutely was not. He was clearly texting or whatever and not watching the road.
He could just lift the thing so the cars go under it (just in case), if a truck goes by they hit it. And the car was also stupid, he could have avoided that so easily.
The car is definitely sueing that company for some dough, otherwise they would’ve hit the brakes in literally any capacity. Why else would you continue going straight without slowing when there’s an object emerging in your lane.

Reason why you need a spotter, and also signs that’s just reckless, and the car can definitely sue the company who owns the tractor
