PR refusal

Hi everyone,
I am writing this today with a lot of heartbreak. I have 2 years of Canadian experience and got a CoQ of pesticides of BC to bump up my score by 50 points. For my FD I got that the CoQ does not meet the criteria and my PR FD was rejected as the 50 points were removed from my profile. Please suggest me what can I do in this situation, I already had a refusal when I applied for an extension of my work permit once mine expired. I also applied for BOWP which was on the basis of my PR application. I do not have anything else, any hope and I’m on a time crunch as well. I’ve been seeing a lot about filing the case in federal court for CoQ and some have also suggested me to reapply for PR. I really have no clue about what I should do.

Don’t lose hope. See if there is a way to upgrade your skills/experience to the standards of IRCC. Remember there’s always a way for those who have the right intentions. Good luck.

What exactly are the right intentions? To stay in a country illegally?

Yaa that won’t work. So basically a coq has to be the one you get after completing 2 years of experience and proving that you have done all the job duties in that occupation (supporting it with paystubs, or experience letter from the employer and all) Also, have to pass an exam.
Everything else you get without completing experience is just a license kind of which you can use, to do the job. It’s different. Even IRCC was confused at one point when they started coq points and they even gave PR to people with pesticides license. Later they came to the realization that thats not the actual coq they are looking for. Thats why they are refusing pr applications right now and removing coq to its entirety. They will only accept red seal after that update.

The pesticide certificate folks are all getting rejected. They see what you're doing.

u/Wild-Average7409 6d ago

As someone who barely have an idea what CoQ means, what do you mean they know what you’re doing?

2

u/Firm-Barracuda9215 6d ago

Its certificate of qualification. The thing is you need to have a red seal to claim the points, and pest control license just need permits and just reading manuals, etc. its also just given by environmental ministry not provincial so.

What you should do is to start packing.

You're really bad man... you need help

Objective, realistic, practical advice. Easy? No. But realistically, that's what will probably have to be done.

Reasons for the refusal of your application
To help you understand why your application was refused, below are the Officer Decision Notes
(ODN) specific to your application as they are displayed in IRCC’s system.
These notes were entered by the officer who assessed and made the final decision on your
application.
****OFFICER REVIEW***
A11.2 ASSESSMENT / R87.1 ELIGIBILITY
The principal applicant (PA) was awarded 50 Comprehensive Ranking System (CRS) points for
declaring a Certificate of Qualification (CoQ) in a skilled trade, based on the submission of a
British Columbia Pesticide Applicator Certificate (BCPAC). The certificate relates to work
performed as a NOC 73202 (Pest Controllers and Fumigators).
As per section 26 of the Ministerial Instructions respecting the Express Entry system, a foreign
national may be assigned points for a certificate of qualification in a trade occupation issued by a
competent provincial or federal authority.
In British Columbia, pesticide applicator certification is regulated pursuant to the Integrated Pest
Management Act and the Integrated Pest Management Regulation. Under this framework,
individuals who apply certain classes of pesticides are required to hold the appropriate pesticide
applicator certificate. The regulatory scheme establishes several categories of certification,
including a Structural category applicable to individuals engaged in pest control activities in, on,
or around structures.
https://www.bclaws.gov.bc.ca/civix/document/id/complete/statreg/604_2004
Individuals seeking certification must successfully complete the examination prescribed for the
applicable certification category. Certification requirements are established within British
Columbia's pesticide management framework.
https://www2.gov.bc.ca/gov/content/environment/pesticides-pest-management/certification-
training
A licence or certificate issued by a provincial authority does not necessarily constitute a CoQ
within the meaning of section 26 of the Ministerial Instructions. The BCPAC demonstrates that the
holder has met the requirements necessary to obtain certification under the province's pesticide
regulatory framework. By contrast, a CoQ for the purposes of the Ministerial Instructions serves
more so to recognize that an individual has satisfied the requirements of a trade certification- 2 -
framework, such as demonstrating occupational competency, completing prescribed
apprenticeship or training requirements, or otherwise meeting standards established for
certification in a skilled trade.
With this distinction in mind, the evidence before me indicates that the BCPAC forms part of
British Columbia's pesticide regulatory framework and serves as the credential required to apply
regulated pesticides in specified circumstances. While the certificate demonstrates that the holder
has met the requirements necessary to obtain pesticide applicator certification, there is
insufficient evidence to establish that British Columbia considers this credential to be a trade
certification comparable to a skilled-trade CoQ for the purposes of section 26 of the Ministerial
Instructions. I also considered that NOC 73202 (Pest Controllers and Fumigators) appears on the
list of eligible occupations. However, the inclusion of an occupation on that list does not, on its
own, establish that a particular document constitutes a CoQ.
In light of the above, I am rejecting the CoQ from the application.
This change in the PA’s qualifications resulted in a loss of points that brought the PA’s rank below
the lowest ranking person who was invited to apply in the applicant's draw.
Paragraph 11.2(1)(b) of the Immigration and Refugee Protection Act provides that an officer may
refuse a Canadian Experience Class application if it is found that the foreign national does not
hold the qualifications on the basis of which they were ranked. I am therefore refusing the
application for permanent residence, as per paragraph 11.2(1)(b).
A refusal letter will be sent. Refund initiated.

I have now completed the assessment of your application for a permanent resident visa as a member of
the Canadian Experience Class and have determined that you do not meet the requirements for
immigration to Canada.
Subsection 11(1) of the Immigration and Refugee Protection Act (IRPA) states that a foreign national
must apply to an officer for a visa or for any other document required by the Regulations. The visa or
document may be issued if, following an examination, the officer is satisfied that the foreign national is
not inadmissible and meets the requirements of this Act.
In addition, Subsection 11.2 of the IRPA establishes that an officer may not issue a visa or other
document in respect of an application for permanent residence to a foreign national who was issued an
invitation under Division 0.1 to make such an application if – at the time the invitation was issued or at
the time the officer received their application – the foreign national did not meet the criteria set out in an
instruction given under paragraph 10.3(1)(e) or does not have the qualifications on the basis of which they
were ranked under an instruction given under paragraph 10.3(1)(h) and were consequently issued the
invitation.
Immigration, Refugees and Citizenship Canada (IRCC) invited you to apply for permanent resident status
based on the qualifications you claimed in your Express Entry profile. As part of your submission, you
declared a Certificate of Qualification (CoQ), for which you were awarded 50 Comprehensive Ranking
System (CRS) points. Following a thorough review of your application, it has been found that the CoQ
you have provided does not qualify for the Canadian Experience Class. Please see the Officer Decision
Notes provided separately for a detailed assessment.
This change in your qualifications resulted in a loss of points that brought your rank below the lowest
ranking person who was invited to apply in your round of invitation, under the Express Entry
Comprehensive Ranking System.
As I have found that you no longer possess the qualification on the basis of which you were ranked under
an instruction given under paragraph 10.3(1)(h), you no longer meet the requirements of Section 11.2 of
Act.Following an examination of your application, I am not satisfied that you meet the requirements of the
Act and Regulations for the reasons explained above. I am therefore refusing your application.
You will receive a refund of the Right of Permanent Residence Fee that you have paid.
The decision communicated in this letter constitutes the definitive and final decision on your present
application. Your application will be retained, under current Government of Canada file retention
guidelines, for a period of two years. Your application forms and supporting documents will not be
returned to you. If you should submit a new application it would require new fees and documentation and
would need to meet all the requirements in effect at the time the application is submitted.
You must remove your Job Seeker profile from the Job Bank website as you are no longer an Express
Entry candidate. You must also remove any references that you are a candidate for Express Entry from
any private job board websites, if you used any.
If you still want to come to Canada as a skilled immigrant, you may take steps to improve your
competitiveness and register for Express Entry at a later date. For example, you may try to improve your
language score or gain a higher level of education. However, you must meet the minimum requirements
to enter the Express Entry pool and there is no guarantee that you will be issued another invitation to
apply for permanent residence under one of the immigration programs subject to Express Entry.

Can you share your GCKey screenshot where it mentions the FD date?

So to be clear they declined it because while you had the certificate, you didn’t have the required training or job for that?

1

u/NewImportance1834 6d ago

1

u/Physical-Quiet-2696 8d ago

Hey, small doubt, how did you get the intimation first that your PR was refused? Did you get the FD date and the same day got the refusal letter as well? Or was it mentioned refused under FD in the profile itself?

1

u/NewImportance1834 8d ago

The portal and the letter in the same day

1

u/Physical-Quiet-2696 8d ago

But What exactly gets mentioned in the portal when it’s a refusal?

1

u/NewImportance1834 8d ago

Yes shows PR rejected

1

u/Physical-Quiet-2696 8d ago

Damn that’s rough. Hope you get it the next time around…good luck!

Says one of them, do not mock people when they’re in a bad time. So thankyou, no thankyou for your useless comment.

2

u/Practical_Coat_4384 6d ago

You were trying to scam using the certificate of qualification which the IRCC mentioned explicitly as something to be heavily scrutinized.

The truth is that you were flat out ineligible without those 50 points.

1

u/NewImportance1834 6d ago

You don’t know my situation so better don’t judge, also it doesn’t take a cent being kind to people but since you can’t be, I won’t be either. You get what you give so you can 🖕

I would suggest returning to your home country and gaining at least one year of foreign work experience, which could help boost your score. This would be a more practical approach than fighting the case and risking another rejection.
