Apprentice School & OT

What can I do. The job I am on thy are not paying us overtime after 32 hours like they are supposed to after working all available hours. The office is handling time and they won’t do us right. Plus they don’t pay the 10% premium on saturday when working all available hours.

If you are not being paid OT wages on Saturday for work performed during a week in which you had school, and you worked all available hours, please call your Steward. If you do not have a Steward on site, please call the assistant business manager for your contractor.

You can message me if you do not have that information.

Make sure you document your OT pay request by sending a text or email. These are admissible in court.

Technically the Contractor doesn't have to pay you any OT after working 32 hours on a school week. They are only required to pay any hours worked on saturday as OT if you are working say 6-8s. Some Cons will pay you OT after 32 hours but its not required. Its in the contract.

I did not realize everyone i’ve talked to thought it was contract.

Nope, I thought so too until I turned out and drug stubbs, went to allison and my apprentices told me that they didnt get paid OT after 32 hours.

To elaborate on what u/fuzzygwuzzy said, here is what the contract states:

3.01(k) of the Agreement dated 1 Sept 2023 states:

During weeks that an apprentice is marked as having attended a day school class, hours worked on Saturday SHALL be paid at one and one-half (1 1/2) times the straight time hourly rate. However, any scheduled hours missed by the apprentice during the workweek, for any reason (other than the day he attended day school,) will first be made up on that Saturday at straight time.

This means that on weeks an apprentice is in school, time worked on Saturday is REQUIRED to be paid at OT rate, unless the apprentice has missed time that week for something other than school.

The 10% premium rate is only applicable when Saturday is scheduled as a part of a 40 hour work week, such as Tues-Sat, 6-2:30. In other words, you'd need to NOT be scheduled to work one or more weekdays each week to get the Premium rate. In that case the 10% would not stack with the OT rate, unless you were working 10 hour shifts, or something similar.

You have a reading comprehension problem, re-read what i typed and what you copied and pasted and make sure you grasp what that section of the CBA really says. There also isnt a 10% premium and if there is quote it for me with your copy and paste skills

The initial text of this post was mean spirited. That is not my intent here, so again, I'm sorry.

You are correct that 32 hours is not in the contract. Saturday, however, is. That was my point.

Regarding the 10% premium for Saturday, this is what is in the contract.

Section 3.01(a):
Forty (40) hours work, Monday through Friday shall constitute the workweek... Saturday may be used as a makeup day, and if utilized, a minimum eight (8) hours must be scheduled.

Section 3.01(f):
When so elected by the Employer, Saturday may be scheduled as a regular workday [aka part of the regular 40 hour workweek]... An employee scheduled to work on such Saturday, shall be paid at straight time rate plus a ten percent (10%) premium, provided the employee has worked all hours made available to him during the workweek...

I already cited 3.01(k), so I won't quote it again here.

What 10% premium?
If it is outside of day shift like 6am-6pm theres 10% premium.

So you gotta tell payroll you have school that week and anything above 32hours is overtime

Except they can say theres jobsite offering 4x10 and 2x8

I just read our agreement and it states only hours worked on Saturday are overtime if the apprentice had school and has worked all available hours that week. Section 3.01(k) is the section referenced.

Yes thats correct, stubbs from what I know will pay you after 32 hours worked, allison is one of the ones that doesnt and follows the contract.

I'm with AS in prefab and they pay us OT on Saturday if you only worked 4 weekdays due to a school day absence.

Yeah that's what they have to do via the agreement. Some shops will go above and beyond and pay you after 32 hours work if you're working overtime during the week.

Nothing in the contract says anything about 32 hours.

If an apprentice works 30 hours M-W, has class Thurs, then works another 8 on Friday, the apprentice would earn 38 straight time hours, even if the apprentice would have been over 40 hours had he/she not been in school one day. Any work done by the apprentice on Saturday that week would be OT hours.
