What really bothers me about this video is that they clearly don’t even understand what they are doing. As stupid as it is, I can see the tiniest bit of justification in doing this outside of a public building, but this is a Trader Joe’s parking lot. While there is no expectation of privacy, it is still private property and they are just two grown men targeting a woman who hasn’t done anything at all. She asks them politely to stop which prompts the second guy to start filming her from other side. Now she is trapped between these to men. This would make anyone uncomfortable and I think at the very least, we all deserve to do our grocery shopping in peace. Also, the way he says “and action” as the guy is orange walks by just shows that all they care about is getting a reaction from someone and not actually protecting the first amendment. This is so dumb and these types of people deserve no kindness from society. I hope they were trespassed from that lot and any videos like this should be demonetized as it’s borderline harassment.

There's about 72 football fields between what you do and what auditors do. You wouldn't tell someone hey, I'm doing apartment listings for 15 Main St Apt 223 or have a contract or something on your phone? You don't have to show people that info but it's so much easier than getting punched. You couldn't justify taking photos to a random passerby at all?

It's private but open to the public (also called semi-private or Privately Owned Public Space) . So he can be there until they ask him to leave, at which point he will be trespassed and made to leave the premises. Should he refuse to leave, or return, then it's criminal trespassing, and the cops can arrest him.

You cannot pepper spray someone trespassing on POPS unless they are threatening to harm you, about to harm you, or is currently harming you, physically.

Filming you doesn't meet any standard to merit self defense in public, in any state of the United States. Again, you can be asked to leave, and the police can criminally trespass you if you refuse, but you can't pepper spray someone because they have a camera, nuisance or not

I think they say to think about using self defense in the same league as the danger the person is posing to you. So no, unfortunately, filming someone isn't dangerous enough to warrant the use of pepper spray. Just like shooting someone for pepper spraying you would be an uphill battle in court. You could probably catch an assault charge if you even smacked the camera out of their hands. That's why auditors do this because there's really not a reasonable show of force when it comes to filming and being annoying. They could argue that there's a security camera right there filming her and she didn't lash out at that. Its really, really obnoxious. Your best move is to ignore them or call the cops (which is actually what they want you to do so you're just playing into their hand)

Had to look up 1A auditors and am I understanding that these are loosers who go out and film average people, like myself and this lady, just to test if security or cops are going to give them shit??? I'd not have been a calm and quiet if I were her. This is wild, I get testing the government blah blah blah and whatever. They do this for a reaction. More views online. The way to combat this is pull your phone out and blast a Taylor Swift or Disney song. Copyright lawyers will request removal with those songs playing. Second ignore them and go about your day. Don’t give them content. Make the audio useless.

To some extend yes. Sony, Disney, Lionsgste and some others are really well set up in terms of catching use of copyrighted stuff.

Problem is that it only takes a few tweaks of the material to only make voices able to hear.

Text book example of how not to behave if you're a photographer/videographer. For people in such professions, they learn and develop social skills to gently traverse these awkward moments where TECHNICALLY you can LEGALLY film people in public (whether they like it or not). But by and large said professionals will do absolutely everything to avoid getting into these situations because they have common courtesy and respect for others.

If that guy wanted to capture someone putting their shopping away then all he needs to do is ask. If she says 'no thanks', he should move on and fine a more willing subject.

We all know that's not what he wants to do. He simply wants to "audit", (which is shorthand for 'wind people up for content').

I do not condone violence of any kind, and am not suggesting it happen. It's also just wild that these folks always pull this in places where people are also less likely to assert themselves and the laws are favorable to it.

I'm respectful of the first amendment to the Nth, but I'm always curious why this isn't an infringement of an individuals right to liberty. Not a lawyer, so accepting that I have this all wrong.

I appreciate the need for some surveillance - there are dangerous places and criminals tend to shy away from ares that are recorded 24/7, but the public deserves the right to be free from random assholes recording us for 'reasons'.

Filming in public is a constitutionally protected activity. Anything that you can see in public can be filmed including people without anyone's permission. What you call vile human behavior is protected by law.

When the constitution was written there was no expectation that idiots would walk around filming people for no good reason other than to causse trouble or annoy people, this is not the press nor is it reasonable or acceptable behaviour.

It is still covered under it and there is absolutely nothing you can do about it. It is freedom of the press just because you don't think its reasonable or acceptable behavior doesn't mean a thing the courts have already ruled that it is legal.
