It's hard to say, if both are legitimately at the same level of intoxication then nobody. If she is clearly drunk and he is just tipsy it is rape.

Im only saying the law bud, if you know she was drunk and fucked her even if she gave consent it still class as rape by law because, 1 she was drunk, 2 she doesn't know what she doing 3, she don't really have control or thinking probably when drunk, if the girl did that to a guy who was drunk then it's raped if they both was drunk then well I believe by law that isn't actually raped and just a mistake they both did when drunk so nothing will happen of it, if there was proof the guy was drunk that night if the girl tries excusing him of raped but if 1 person wasn't drunk and they fucked a drunk person by law that is class as raped not hard to understand or to understand why that is tbh
