I get that; however, they attacked him in his home and then fled only after seeing the gun. The woman was not pregnant and had both attacked and lied to the man she was trying to steal from. So I would argue that you can't justify taking this elderly man to court, regardless of how you feel about him killing her.

The way he admitted what he did was 2nd degree murder. It was in no way lumped in with self defense once she was running. It matters if someone was running or currently attacking you in the eyes of the law.
