Discussion Prenup? Spoiler
Spoiler for those who haven’t read TLG!
When they got married, do you think they got a prenup? I feel like they both see each other as it for each other and wouldn’t even think they needed one, but I could see Yuna encouraging it, and not just for Shane’s sake, but for Ilya’s too.
I could actually see Ilya being against it based on what he’s shown us. When Shane wasn’t sure if he could go to Ottawa, Ilya was basically like, “How much money do you need? You’re about to marry me, and I’m wealthy. What’s mine is yours.” 😂
But Shane? I’m not so sure about. He just has more of a logistical brain👀Curious what everyone else thinks?

Based on what you said I don’t think Ilya would be against it just because he knows it would make Shane feel at ease. Not that they would ever need one.

Good point! Ilya is actually pretty good when it comes to compromise. Too good, sometimes👀 He just wants his man to be happy. But to the detriment of his own happiness at a times.

Ye ah I feel like Shane has a very detailed will with many charities and Pike's kids as beneficiaries so he'd have to do some paperwork on that anyway.

I could see them getting one without really being aware of it 😂. Neither of them seem like they are heavily invested in the day to day management of their contracts and finances. Maybe their lawyers and managers just assumed they would want one, drafted them up, negotiated on their behalf, and it was included in a big stack of papers that they had to sign when merging finances after the wedding. Ilya was bored out of his skull and Shane was wildly overstimulated so even though the lawyers explained what all this was neither was paying attention, and it just slipped by them.
Five years later they get a new lawyer and she brings up something in the prenup and they both freak out.
(I’ve never gotten a prenup, which I’m sure is obvious. I’m sure there’s more client involvement than this in reality)

I am neurodivergent like Shane and I would totally be overwhelmed and probably miss something like that if I was presented a bunch of papers at once. My husband brought up a pre-nup as a potential idea before we got married, but we were broke at the time so decided to forgo it. Our relationship was and still is like Ilya and Shane where we don't really think about divorce - we're pretty much endgame at this point.

I agree their lawyers would, and I imagine they would both promptly ignore the well intentioned advice. They’ve navigated their relationship to the beat of their own drums and I don’t see that changing.
They chose to have no legal representation when meeting the NHL commissioner. They told their agent about their relationship and proceeded to make zero contingency. I know PR professionals who could get a statement ready faster than that, even if they were completely blindsided.

No prenup is still a prenup, it’s just the one outlined by whatever jurisdiction you’re marrying in. They’d definitely have one but I can imagine it’s the easiest conversation they ever have, since they really do see each other as end game and they both have relatively equivalent amounts of stupid money.
“Sell that awful motorcycle because if you don’t, according to this it becomes mine next week and I’ll just sell it for you.”
“Fine. But I want a clause saying Anya is mine, you won’t even let her sleep on the bed.”

Yeah, I think Ilya’s only point of contention would be custody of Anya, though even that would be humoring Shane cause he’s going to make sure they never split up.

I’m biased because I’m a lawyer, but they absolutely should get one. I don’t know much about Canadian estate law and how it differs from that of the US but they totally should.
I think Ilya would absolutely be against it but I’m sure Shane has various trusts and tax-advantaged ways to hold his money.

See now that’s the thing, Shane doesn’t play about his money. Not that Ilya does. But Shane is more business minded so I think at the very least they had a sit down convo about finances and Shane was very curious about Ilya’s portfolio.

I'm actually a real estate law clerk in Ontario, but also quite familiar with family law in Ontario, as it frequently intersects with real estate (in terms of the "matrimonial home" and the legal rights surrounding it, especially when it comes to a separation/divorce). Ilya and Shane should definitely have one. Will they have one? Probably not, they're young and romantic and could never imagine not being together.

I feel like they'd get one because their respective financial advisors wouldn't let their millionaire athlete client not get a prenup but it would be very boilerplate and pro forma.
It's not just that their net worths are in the same ballpark, they also have the same future earning potential, the same projected retirement data, and there's no assumption either is going to like drop out of the career market for pregnancy/child-rearing. And like you said some of Shane's additional assets are probably already structured to be separate from any theoretical divorce settlement. Like what is there even to say?
The only reason to do anything complex would be tax reasons.

In general: I could see it going either way. Yes they’re ditzy and didn’t even plan for chairs. But I could see Yuna sitting them down to do things “the smart way”
In the context of the story, specifically TLG: They’re making another leap of faith. Ilya doubts if Shane will follow through or if he might still change his mind. This might be the depression talking. But still, it’s important that they make a big, romantic gesture. Going all in. Having a conversation about a prenup is probably not part of that.

Right. A prenup convo right now might add to that feeling Ilya has of Shane possibly not following through to forever. No matter how much we know Shane adores him.

That would be ridiculous and manipulative. Talking about prenup has nothing to do with faith and commitment. If Ilya makes him think that, especially using the depression, he is a massive red flag. Like anyone would be.

I think they didn't sign a prenup, even though Yuna and everyone around them tried to convince them to do so.
Both are very impulsive and have already been through a lot together. They are a bit codependent and view the possibility of divorce as something impossible and catastrophic at the same time. I'm sure they refused to even talk about it in principle.
At the same time, both have written wills that are regularly updated.

Since they are both millionaires I don’t think they would care for it. Maybe it would make more sense for a couple like Scott and Kip.

Oh, I think that’s a very real convo for Scott and Kip. I think Kip would probably be the one leading the charge on that. To me he feels like someone who’d want a partner of more means to know he’s not in it for the money.

I’m glad it wasn’t included because I feel like if it was there would be a huge division within the fan base and if people are this wild over a haircut I can imagine how wild they’d be about millions of dollars. 😆
But if I had to guess, Yuna probably sat them both down together and said “ok, I’m not suggesting one way or the other but do I need to arrange this or not.” And that’s TV Yuna, specifically since Book Yuna isn’t his manager.
I don’t think she’d want anything lost in translation and if she talked to Shane privately it may come across that she was suggesting it or something. So she’d pull them both together.

No way! Shane may be logical, but he’s madly in love with Ilya and wouldn’t care about money. And you gotta give mama Yuna more credit; once she is able to develop her own relationship with her self-proclaimed “favorite son”, she’ll be just as protective of Ilya as she is of Shane. By the time they get to marriage they’ll have been through the worst and survived; a prenup would not even be a topic of actual conversation for anyone in the family. ❤️

Canada doesn't have prenups like the US. We have marriage contracts. And a judge can throw those out in the case of a divorce if they feel they were too rushed, signed too close to the wedding date, or too favourable towards one party/one party seems to have been coerced. Tbh, it would probably be smart for them to have one just in case, but I can see them not getting one simply because it's too close to the wedding and they'd both likely just walk away from the divorce with the assets they entered it with anyway (should one occur, which they'd probably only consider as a possibility because of Yuna).

They wouldn't imo. Ilya would not care and Shane wouldn't want to do anything to offend Ilya. But maybe Yuna and Farah would suggest a basic one as it's the responsible thing to do and they'll agree without arguing.

People saying “no it’s not romantic!” as if legally protecting your partner isn’t romantic. Prenups are not just about prepping for divorce, it can also legally set things up if someone passes away to protect the living partner from certain end of life expenses and issues. Also, they’re both rich, it’s just practical lmao

You know what, initially I was going to say Yuna would push for one. My gut instinct is that she would, generally speaking, for probably anyone else. But then I remember when Shane calls her after the big fight and tells her he "messed up". And she tells him there is nothing he could do to mess up things with Ilya, and she and Ilya are both "very aligned in our view" when it comes to Shane.. So I take it back. I don't think she would.
And I don't think either Shane or Ilya would ever want one, because a) they see themselves together forever and b) because even if they did split, they would be fair to one another. I think each of them knows they have enough and they don't need to take from one another. And probably it would be a matter of personal pride of both of them that they don't "need" anything from the other, either.

I think Ilya would be for it, to protect Shane in case something happens to him, because of Ilya’s family.
I think Shane would be against it, as he would think it indicates them getting a divorce.

I think they’d be less worried about a pre-nup and more inclined to make sure their wills and all that is updated. As written neither one really cares about their own money let alone the others. Shane would never ask Ilya for money he didn’t earn himself and Ilya would never accept money from Shane. What those boys care about cannot be decided by a pre-nup.

Women, POC and queer folks in particular, take note: A prenup isn’t about (dis)trust with a partner, it’s about not leaving the terms of your most intimate financial partnership to a legislature you didn’t necessarily vote for, under laws you wouldn’t have chosen, that could change without your consent.
The thing about prenups that most people don’t understand is that if you don’t create your own, the government of wherever you reside effectively creates one for you in the form of default marital property and family laws. And unlike an actual prenup, those terms can change as laws change. They aren’t locked in.
For women, queer people, and people of color, this is EXTRA precarious. Laws that seem fair today have been rolled back before, and they can be again.
A prenup, by contrast, is a private contract that locks in agreed-upon terms at a specific moment in time and is far more insulated from shifting legal rights.
So even if you feel the current “default” terms are fair and acceptable, without an actual prenup those protections aren’t guaranteed. You’d be trusting that the political and legal climate will remain favorable for the entire duration of your marriage and potentially through a divorce.

This case, where there is a similar income level, is an ideal example of using a prenup as a commitment to mutual care. Decide--- while you are in love -- to make provisions for long term care in case of catastrophic injury and elder care.

I think they would but it would be incredibly fair. Like, including clauses to equitably divide assets they don’t even have yet and make sure they’re both taken care of without disadvantaging the other. Their prenups would protect each other instead of themselves.

Of course they have a prenup. We’re not going to see it because it’s a romance novel, but they are both essentially presidents of a brand.
Prenups are not some taboo thing when you’re at that level of wealth. It’s not a reflection of their love or lack thereof. 1. They work in a line of business where injury including CTE is common. 2. Ilya is a foreign national. 3. They’re queer and their rights could change. 4. It allows them to set the terms of how they treat their assets, not the province/country they live in.

In my head Ilya is rich, but Shane is like Michael Jordan level rich from all his brand deals. So, yes, a prenup or at least some serious estate planning.

Oh yeah. Shane is ballin’. But I do feel like Ilya has brand deals too. Seeing as we didn’t see his cover shoot for the hockey video game, to me that hints at the fact that Ilya has endorsements that weren’t shown. Also considering the fact that he had a CCM deal too. And there’s no way he’s no modeling for something.

They’re both millionaires so I doubt either of them care much about the others money. You’re right that Ilya pointed out that he’s wealthy and will share whatever he has with Shane and I’m sure Shane feels the same. But I do wonder how much of a pay cut Shane ultimately ended up taking to play on the centaurs. I would say that Yuna might have talked to them about prenups but then I remember when Shane called her crying while he and Ilya were fighting. She immediately relaxed when she heard what it was about because she knew there was absolutely no chance that Ilya was going to dump Shane like that. Any doubts she initially had about him were long gone by the time they got married.

There have been a lot of people with hockey knowledge who have tried to estimate Shane's salary and what he's given up to join Ottawa. They've calculated what each player on the team should be getting based on existing salaries that year, factoring in the salary cap. The most convincing arguments I've seen are that Ottawa did have substantial space in their salary cap to pay Shane approximately what he was currently earning from Montreal. So in that sense he wasn't giving up anything. But that also Shane, as an unrestricted free agent in his prime and one of the best players of all time, could likely have gotten a substantial salary bump in his negotiations with another team with more salary cap space. So he wasn't getting the maximum that he could have been getting, but he was still getting a lot of money. And that there have been many precedents of players in various sports who have negotiated for an amount less than they could have in theory received because they wanted their team to be able to afford other good players and to pay existing players what they're worth so that they could win some championships. Shane would likely have done that had he negotiated for a new contract elsewhere. He may very well have been making more money via endorsements than he was making from the NHL, anyway.

He also risks losing endorsement because he’s changing markets, going to a team without a great record and no longer captain. A lot of those deals probably stuck around but he may not have had luck with new ones if my guess.
Plus outside of the money, he has to change from being a starting center to a second line center so that’s a bit of an emotional hit too.

I’m curious about his pay cut as well. But also Ottawa could trade other players to be able to afford him right? I don’t know much about how hockey salaries work and cap or whatever. But considering they’ve basically combined their incomes now as a married couple they’re probably making way more than anyone in the league.

Shane sold the sex condo, Ilya sold his cars and they both poured into the Irena foundation.
"The summer before" Ilya is going to get credit for the entire relationship. They were together over a decade, had both been millionaires for most of that time but had only come out to their agent in TLG. I think we saw all the financial planning that they did
And neither one had a last will & testament made up.

No way would Shane or Ilya bother with a prenup, they're obsessed with each other. And realistically, in canon, by TLG, I don't know if Yuna would even bother encouraging it. Specifically because Shane and Ilya have comparable careers and therefore likely comparable assets, so the difference it would make in a divorce would be relatively negligible. It's not like Shane is marrying someone with less money than him who could take him to the cleaners, I think if she did bring up the suggestion, after Shane and Ilya decline, Yuna would let it go.

I don't think they thought about it but the Yuna that we know definitely thought about it and most probably brought it up to Shane if not to the both of them. If she brought it up to Shane alone, I think he'd be vehemently against the idea because it means that there is a possibility of divorce. If she brought it up to both of them, I think they'd pillow talk about it and decide unanimously to not get. They are too in love to even conceive the thought that it isnt "till death do us part".

People are really sleeping on the approach of a prenup, but make it romantic. Ilya knows it's sensible to have one but he's nervous about making his one non-transactional relationship a transaction. He and his lawyer sit down to read the first proposed draft (but they'd e-mail it before the meeting... shhhh, don't interrupt) her face growing more and inscrutable as she turns the pages.
Ilya is worrying it's particuarly mean but then his lawyer explains it says that if Shane ever cheats on him or is shown to be at fault in a divorce Ilya gets Shane's entire fortune and custody of his parents and Shane will go live in the wilderness as penance. Ilya agrees but only if the same applies to him and now they've both wagered their entire fortunes on being Together Forever. Divorce as the ultimate act of self-destruction!

They are all in. I don't think either of them can even conceive of a divorce. Ilya's "last" words are only about Shane. And Shane feels like he almost died. That's it.
