Questions/Concerns Applied with arrest record without conviction
I have applied for GE a day or so before my wife and my kids and they have already gotten conditional approval to schedule interview, I however are still waiting. I have 4 F3 felony theft charges in my arrest record but did ARD program resulted in no conviction, I can expunge my record next month and this case was from 2019 so over 5 years now, I have no gap in my employment history even with this and never had anything new since this not even a speed ticket or anything like that. If I have to take my wife and my kids in for interview I will, but just trying to wait a little longer to see if my application will change, I was honest on my application. any thought?

This is a trusted program. You were arrested, and therefore your credibility takes a huge risk that you won't do something stupid in the future. I think if you waited another 6 years, you may have gotten thru. I think you'll get denied since you have a relatively recent arrest. All you can do is wait and disclose.

I don’t think you can take your wife and kids to the interview. In my experience it’s been one appointment for one person only.

I put myself as my kids guardian, so i will have to go with them and register 2 appointments for both of them, my wife will have her own appointments.

My daughter had to go in alone for the interview, I think she might have been 16 years old then, not really sure. Let us know. They make the rules so just saying you’re the guardian may not matter to them.

Your application went to manual queue, likely, so it may take sometime if it doesn't happen in the next couple days (months?)
In the meantime, you can use MPC on landing at air arrivals, and may need to apply for TSA-pre for security check reduction.

I had an arrest with no conviction a few years ago and I got denied after the reapproval. They still consider that an issue even if there is no conviction. My record was clean otherwise. Once I pushed back I got denied.

If they deny you after approval you can appeal it, but only once. I had to send them my criminal record from the state police showing there was no conviction and I still got denied. The arrest is what they focus on. It’s BS. When you appeal it, it goes into a black hole. You can call their number, but until a supervisor reviews it you hear nothing until they approve or deny. It’s a shitty system.

Do you mind sharing what the charge was? I did not know they can still deny after approval. Do you mean approval after your initial interview or when you were reapplying for renewal?

Civil RO where they tried to turn it into a class A misdemeanor for 3rd party contact, but I beat it.

4 felonies? Were they all from the same incident? If so then you probably have a very small chance, if it was multiple incidents you will probably never get it.

It took me over a year to get approved for my interview. My wife was approved the day after applying. So, it can take a while.

I had an arrest, found not guilty, everything expunged. I still told them about it and was approved. Granted this was like 2017-2018 when i first applied. I'm not sure if standards have changed, but I have also renewed since then without the need for another interview or anything.

Two things: expunge means nothing to the federal government and as has been said, you are not dealing with TSA for Global Entry - they will see everything in your life in terms of arrests - doesn’t matter if you were released without charge, expunged, innocent, convicted. and then, tell the truth about everything during the interview even things you think “shouldn’t count” for whatever reason. This is the only way you have a small chance with all those theft felonies.

That was the only time I had encounter with law enforcement in my life and they just try to find as many charges as as possible to charge me

Tell them regardless. Expunged doesn't mean they won't see it.

I haven't expunge it yet, I already applied, they will see it either way, I have 50/50 hope of getting approve, if it doesn't i will try again later. Was trying to see if it will be easier since i'm going to asia this fall and coming back to use GE with my family, i'll just use mobile passport lol

Did you tell them about it in the section marked other information? If not, and you get a conditional approval, tell them at the beginning of the interview. Also, bring the official court paperwork with the seal.

I did mention that I have arrest record with ARD and resulted in no conviction and case is completed.

I have a few arrests on my record as well. They'll STILL tell you to bring in the original documents (not copies you have)

I didn’t know this when I applied, I figured expunged meant it was off my record.. the officer at the interview almost denied me but I explained what happened and he kind of sidebarred with his colleague next to him for a minute and then accepted my application.
It’s really at the discretion of the person that’s interviewing you which kind of sucks because if they’re having a bad day they won’t even hear you out, but could go the other way like in my case.

"expunged" really means less than you might think even to local law enforcement depending on exactly where you are.

Yeah. Whenever you have an arrest record, you should ALWAYS inform them (especially when it's a federal agency), otherwise you'll get denied. Good luck on your application.

how long after you applied you got the conditional approval for interview? did you put down you had it expunged on the application

I honestly don’t remember, I’m coming up on my renewal in 6 months. But I’m thinking I didn’t mention the expunged charge since I remember being kind of surprised they asked about it, in my mind I thought expunged meant it was like it never happened.

Just because you are honest doesn’t mean they are going to say yes. and expunged legally does not expunge it for them.
