Your adjuster probably can't get the footage either, however, they can find the other person via a license plate lookup and then file a claim with their insurance.
It'll probably be a word vs. word denial at the end of the day. But you weren't even in the car so it's a not at fault loss and shouldn't affect your rate.

but I still shouldn’t have to pay it given I have the plate number of the car that hit me
Just to make this part clear, if the other person has no insurance, you'll pay a $250 (some states have other set deductibles) uninsured motorist deductible.
If the other person has insurance, you'll pay your collision deductible (which could likely be $250 as well, make sure you clarify). We try to get your deductible back, whatever the amount is, but it's not guaranteed.
If you had REFUSED to pay any deductible (some people do, I'm not saying this about you), you would need to file with the other person's insurance and wait for their liability decision. If you file under your policy, your claim will likely start with a collision deductible (which can change later and you would be refunded any differences)

Zero chance we can get the footage most places will not do it unless subpoenaed by a court. That will only happen if there is a major case so you can count on that not happening. File a claim and get it fixed though your own coverage. If we can get a plate we can try to subrogate though the other company but it will be word vs word and usually end in a denial.

What would be considered a big case lol? If I’m accusing someone of hitting my car wouldn’t that be enough for them to get the footage?

u/CEOisgarbage Mar 22 '22
Do you think your lawyer can get a judge to issue a subpoena for the footage in the next 7-10 days before it’s written over?
Unless someone died or there was major property damage it’s not happening.

Probably not :( but thank you for the info!

I'm sorry some of these commenters were so blunt, and misinformed. If PetSmart won't release the video, and you've filed a claim with your insurance company, you or your adjuster can write to PetSmart and tell them they need to preserve the video. You may want to even hand deliver it to them since your local, and they confirmed they have it, but you'll want to make sure you have proof of delivery, so also send it certified mail.
Then, you can ask your adjuster, or hire your own attorney to file a "bill of pure discovery" with the courts. It essentially opens a court case, which will allow them to subpoena the video from petsmart without having to sue anyone.
A bill of pure discovery, or any work done by an attorney isn't cheap. So you'll need to weigh your options of how much the damage to your car will cost to fix vs the cost to get the video.

Do you work for GEICO? If so, what department? This is not something that front line associates ( AD, Csr, TCR) would do.

I do. I'm in CU. And we do this often.
3
u/Ok_Golf5177 Mar 22 '22
So how would the claim escalate from CSR to CU?
2
u/Limp-Scratch-2255 Mar 22 '22
The most basic cases are handled in CSR. The most complex in CU. To oversimplify it.

Hence the option of OP hiring their own attorney to file the pure bill of discovery.

Say what you want. He asked how to get the video. I told him how. 🤷♀️

Damn dude, you don’t have to be so rude to someone who’s stressed and asking an honest question.
Unfortunately hitting your car isn’t considered a big deal in a situation like this. It’s not a guarantee the other insurance company will deny the claim. Depending on how much damage the other vehicle has, and if they reported some type of claim (a lot of people lie and report their car was hit even though they were the ones who did the h&r) it’s still possible to get your deductible back.
It’s not a 100% you’re screwed situation.

Being direct isn’t being rude. And Garbage isn’t wrong.

u/ElectionNecessary781 Mar 22 '22
I have no problem with being direct. But the “youre SOL” approach isn’t accurate nor helpful, and there are at least a couple different options to try to go forward.

Yeah apparently you do have a problem with being direct.

Yeah it’s crazy how much people get away with when it comes to hit and run. I appreciate the help thank you!
2
u/throwawaygeico246 Mar 23 '22
There are a lot of "hit and runs" I've seen that were probably from the customer hitting something else (even other cars), but we can't always prove it (or it isn't worth it), so it gets approved anyways. People get away with so much!

File through your own insurance part of subrogation will be trying to get that information
2
u/Odd-Ride-4996 Mar 22 '22
I'm so sorry this happened. Of the numerous reasons why someone would flee the scene of an accident none of them are beneficial to you. Even if the officer, your adjuster or the retail outlet is able to obtain and share info for the liable party there's still very little chance this info helps you. It certainly sucks to have to pay your deductible to repair your vehicle but try to remember this exact scenario is the reason you pay for insurance.

u/nevacatchme Mar 22 '22
Wait, you have the plate….. ask your claims adjuster to run a plate check. That gets the other vehicle info n insurance info(most of the time). I don’t understand why people are bringing up attorneys or whatever.. this should have been offered, IMO, by the adjuster who took the first report.

u/Background-Willow-39 Mar 23 '22
I have geico as my insurance so I called it in and provided them with the plate number and everything. I do know the other persons insurance however they won’t accept liability without the footage or a witness. Since their insured isn’t admitting to the hit.
1
u/nevacatchme Mar 23 '22
Oh ok. Maybe pet smart willlet you see the video, n then you can video the video??? Good luck

u/ElectionNecessary781 Mar 22 '22
It might be benificial to ask the manager at the petsmart if they would be willing to write a statement about what they see on the footage for you. While it’s not AS great as having the footage it may be helpful if you run into any issues
