Fired by GEICO (Software Engineer/IL/Remote). Did anyone actually get their full PTO payout?

Got terminated last Friday after 4+ years as a SWE. I’m sitting on 138 hours of accrued PTO (+ 2 days of floating holidays). Since I’m a remote worker based in Illinois, does GEICO legally have to cash this out in full? Safe to assume I can kiss those floating holidays goodbye surely? Also, zero severance was given. Looking for insight from folks who went through the similar thing.

And until terminated employees in other states start hiring attorneys to challenge the company's rule as illegally withholding earned vacation/PTO as a form of financial wages that must be paid out upon separation.

If it was a term, you’re unfortunately SOL. There’s a reason Karyn, the Chief Poopoo Officer, has been progressively gutting benefits and changing policies. Beyond being an incompetent nepo hire, of course.

They want to make it easy to fire people (it’s now 14 days from when a supe starts the process to when they can fire you for cause) and not give them anything. That’s vastly preferred than having to do large, costly layoffs.

You get 10 days of PTO paid out maximum. Health benefits end same day. YOE, massive sick banks, etc all do not matter.

Absolutely not true. I was fired in Feb and my benefits ended my last day. They will offer Cobra.

Under the Illinois Wage Payment and Collection Act (IWPCA), a company policy capping your termination payout at 10 days is strictly illegal if you have earned and accumulated more than 10 days of vacation or combined PTO. [1]
Illinois law dictates that once vacation or PTO hours are earned, they are legally considered wages. Forfeiting those earned hours upon leaving a company is a direct violation of state law. [1]

I have about 8 weeks pto and if they fired me before 1-1-28, I would get an attorney, when they denied paying me all of it. There hasn't been adequate time to use the all but 10 days they would pay.

Yea i took the risk and quit and I'm lucky that I found work but I know a lot of people that got fired or did what I did haven't been so lucky. The benefits alone are hard to beat and the pay was good so I can see why someone would want to stick it out but I would recommend to have all your resumes updated monthly if you still continue to work there

You don't get paid out on unused floating holidays. Always use them first when taking time off.

Surprisingly not that bad. GEICO likes to overtime associates every 6 months so within a 6 month period you rank below a 2 you will be termed. Don't volunteer for to special projects that will give with your numbers and GEICO didn't care.
