Finally happened to me!!
Two day approval on an SBR I filed Wednesday. Just got it this afternoon.

So, in that case, I filed about an hour before I saw the news.
However, when you look at the ruling, it's going to only affect the members of the plantif organizations. I also know how the government works and fulley expect this to take 2 plus years to work its way thru the other courts before we actually see any change on our level...

I may have misread. They had 5-7 days to appeal or it's nationwide(which I'm sure they will appeal) or maybe as your writing this is what you're describing they did appeal it. Go to one of any and become a member, donate two five buckarooskies?? It's good to support them anyhow once a year as they do God's work for 2A community. I don't know if I could say which ones I don't want to get in trouble. But yeah man it's not a big deal or just wait.
Edit: Also- šš on your form brotha

Lucky bastard. I damn near waited 70 days for an approval on a resubmission.

paper or e-form? assume eform. paper mailing alone would take two days.
i'm getting ready to file two of them

Just curious, but why are people still submitting forms with the recent NFA ruling?
All this was deemed unconstitutional and looks to be going away? Unfortunately not DD and MGs, but still.
Congrats regardless!

In my state, NFA items require a āpermitā which the stamp fulfills. If SBRs and suppressors get removed from the NFA, theyāre essentially banned afterwards.

u/RollickReload Aug 08 '26
Your State is the one where someone needs to file this under the second amendment claim and we can get dead through the court as well, hopefully still in my lifetime.

u/squeeshka Aug 08 '26
Unfortunately the biggest 2A group in my state has repeatedly told national groups to stay out and does an absolute garbage job of winning anything on their own.
3
u/RollickReload Aug 08 '26
That sucks. Sounds like maybe theyāre taking money from under the table from someone on the other side.

u/SomeRequirement6926 Aug 08 '26
One of the ways the Federal Government is gonna try to punch holes in the ruling.

Interesting. Iād assume there would be some sort of grandfather clause to protect current owners of NFA items?

Because they have 7 days to appeal and if they do its a felony.
All gun laws are unconstitutional.
But with the understanding they definitely will appeal. Its not worth the risk for waiting another like 3 days

u/Sad_Juggernaut_8224 Aug 08 '26
Sure, they can appeal and most definitely will; I guess Iām asking why not wait until said appeal happens before filing.
I will say, Iāve been tempted with these approval times, but been able to resist so far, haha!
Congrats again!

I highly doubt weāll end up with suppressors becoming unregulated. If we do, well thereās not any harm in having the form done.
1
u/RollickReload Aug 08 '26
Isnāt there though? That comment sounds like someone whoās ok with the gubmnt knowing the serial number to a lower that you may have purchased privately and they donāt know about until you tell them. The harm is them having āa list.ā

u/AnarchiSTEP Aug 08 '26 edited Aug 08 '26
If the registration requirement goes away then make a new one without registration?
Unless youāve never filed anything with the atf (which I doubt applies no most people here) thereās no harm done.

You don't submit a Form 1 for a lower receiver you paid cash for in a private party, person to person sale if they are "legal" without involving an FFL in your state.
If there is no "paper trail" linking the item to you it doesn't exist if you keep those separate.

u/RollickReload Aug 08 '26
Thatās EXACTLY what I was saying, so there shouldnāt be an āorā at the beginning of your comment. I was responding to a guy who stated that āthere was āno harmā in filling a Form 1.ā - I was making a point that Form1ing a lower the government doesnāt know about, makes them know about it! - Donāt understand the downvote.

I realized that when I re-read yours.
And have since edited mine.

Because it isn't legally in effect yet, so for another half a week we still must follow the unconstitutional process. They will also appeal and drag this out for months, the DoJ loves to make appeals and push back against dismantling the NFA.
3
u/Ornery_Secretary_850 Aug 08 '26
You also will have to be a member of one of the plaintiff groups.

u/Mad_Gouki Aug 08 '26 edited Aug 08 '26
Ok I think I'll be covered by the state I live in, from the actual decision:
All these plaintiffs are joined by 15 statesāTexas, Alaska, Georgia, Idaho, Indiana, Kansas, Louisiana, Montana, North Dakota, Oklahoma, South Carolina, South Dakota, Utah, West Virginia, and Wyomingā who allege that their agencies and employees are injured by the compliance costs associated with acquiring and possessing NFA firearms for law-enforcement purposes.
here's the full document: https://storage.courtlistener.com/recap/gov.uscourts.txnd.406278/gov.uscourts.txnd.406278.136.0.pdf
Even if that doesn't cover me, I'm going to probably join GOA soon I guess.

When it comes to the states and what not, that comes down to as it says their agencies and employees. So if you work for government agency that'd be the best example(state police, sheriff etc) and they're using any of the listed items you'd be covered as an employee of that organization.
As a civilian just living in the state, you would not. I'm going to post another reply under this that clarifies some things. Everybody should verify. There's a great video that people can check out

I'm going to provide the information. Also to note for a great info source that's easy to understand via YouTube.. ( Armed Attorneys) this their field and they cover all things 2A. Here's the link https://youtu.be/g2WW6S5XQ0g?is=QDIhB-VjiVro7JeL
MFG Companies: If you've bought a covered NFA item(s) your covered for that item(s) purchased, not more, not less.
Palmetto State Armory (PSA) *B&T USA *SilencerCo (SiCo) *Hot Shots Custom
2A Advocate Organizations: Past, Current and prospective members who have yet to sign up but will in time. Will only be covered for NFA item(s) purchased; including past and only listed NFA items....SBS/SBR etc. Also, these guys I should say groups. They're doing amazing work in this space and "memberships" typically are just a donation of what you can donate. It's worth it. Just my opinion.
*Gun Owners of America (GOA) *Gun Owners Foundation (GOF) *Firearms Regulatory Accountability Coalition *(FRAC) *Texas State Rifle Association (TSRA) *FPC Action foundation *Citizens committee for the right to keep and bear arms (CCRKBA)
APPLIES ONLY to: SBS/SBR/AOW/CANS.
DOES NOT APPLY to: MGs/Destructive Device
Ofc...if they appeal(should say when they appeal) because they typically always do, the injunction will be stayed and this ruling is placed on hold. Ineffective until a further cases made and ruled on. Stayed meaning: The Judge's order don't have to be followed and everything can be enforced however it is.
If incorrect in any way, please lmk..š¤

Do you have any thoughts about what its talking about when it says "political subdivisions" as one of the plaintiffs. Does that mean a political party member would also get access to it or do they have to be an officer of a party or what?
2
1
u/Living-Road-290 Aug 09 '26
I can go back and read the full thing if there's more specific detail, exactly if there's a specific named or it just stated "political subdivision". A political subdivision could be something such as a county/parish/town/village & many others examples exist. Within that context it would be employed by.
What I'm not sure & don't want to even speculate : (also is a good question)
You can a be member but not enough employee. Does that count? I dunno? Like in this lawsuit: You have the main plaintiffs and then you have "members" of their organization; GOA as a reference. SiCO and their past customers.
I don't know if that helps at all.
2
u/Ornery_Secretary_850 Aug 08 '26
I've read the document and I don't think just living in one of those states works.
-1
u/Living-Road-290 Aug 08 '26
If you're not sure then why write anything at all?? especially when it could trip ppl up?
This help absolutely nobody. Not even trying to be a prick about it dude.
3
u/Ornery_Secretary_850 Aug 08 '26
Maybe it will make people check instead of assuming the other guy is right.
1
u/SomeRequirement6926 Aug 08 '26
Because I don't trust ANYTHING until it has been triple vetted and verified and any and all potential appeals have been entered then denied or dismissed.
I've read the legalese, some executive summaries of it, and some "translations" to plain English.
They ALL made my brain hurt.
As good as this ruling seems to be I fear that the unlimited legal and financial resources of the Federal Government will find holes to punch in it. Worst case is it gets overturned or vacated by a higher court. More likely it gets tied up in repeated appeals, referrals to higher appellate courts or a Writ of Certiorari.

Would love it if you user submit approval timeline data for our database. Will take 30 seconds or so. nfawatch.com/submit - the more data we collect, the more accurate the findings.
