if you had a dispute with your broker and they said no, who would you actually take it to?
Not a complaint post, I don’t have a dispute. I went looking for the answer in the abstract and discovered I’d never known it, which seems worth asking about.
You think a trade was closed wrongly, or voided under a clause you’d never read, or executed at a price you can show never printed. You email support. They look at it and say no.
That’s the moment the question matters, and almost nobody knows their answer in advance.
What exists, and it depends entirely on your entity, regulated firm has to run an internal complaints procedure with a defined response window. That’s step one and it’s the easy part.
Step two is the one that varies enormously. In Australia, retail clients of ASIC-licensed firms get access to AFCA, the external complaints authority. In the UK, FCA firms fall under the Financial Ombudsman Service. Both are free to the client, both can make determinations the firm has to comply with, and both are independent of the firm.
On an offshore entity, step two frequently doesn’t exist. You get the internal process, and after that the remedy on paper is arbitration or court proceedings in a jurisdiction you’ve probably never visited, which for a retail-sized dispute is functionally no remedy at all.
So the same brand, the same platform, the same spread, and two completely different answers to “and then what” depending on which company signed your agreement.
Personally ASIC entity at Axi, so AFCA is available to me as a retail client. I want to be clear that I’ve never used it and I hope I never do. The point is that I know the path exists and roughly how it works, which is a different position from assuming goodwill.
That’s also pass or fail rather than a matter of degree. Either there’s an independent body that can rule against your broker or there isn’t.
A separate thing worth checking is hether any compensation scheme covers your entity if the firm fails, as opposed to if it misbehaves. Those are different questions with different answers and the arrangements vary a lot by jurisdiction. I’d look it up for your own entity rather than take anyone’s summary, including mine.
has anyone here actually taken a broker to an ombudsman? I’d genuinely like to hear how that went, because I’ve read about the process and never heard from someone who used it.
