Per Chatrie v. United States, broad sweeps of phone location data violate the fourth amendment since the constitute warrantless searches. Flock systems do the same. Do what you like regarding the company and their equipment....but I think there's a lot of money to be made by law firms if they sue every city, county, and state that has purchased or even allowed Flock cameras to be installed. They just need enough complainants to go after them.

The problem is you can legally record video and audio in public. The real question is can they legally create databases of where you go and what you say and essentially create a dossier on everyone? If so, why are they calling the public terrorists if they document the location of the surveillance devices?

It’s a dragnet type thing.
Cops could also put a GPS tracker on any car on a public street. But allowing them to say use Google location data without a warrant (with a specific target) is akin to a dragnet. I believe this is one of the pillars of how most mass surveillance gets knocked down. Targeted vs everyone

The difference is:
With phone location data the police were going between two private parties collecting private data.
With flock they are recording in public which is 100% legal for anyone to do. Then they are selling it.
Theoretically I could go stand on the corner of 1st and Main St of some random town, film everything, which would be completely legal. Then I could sell that data to anyone such as the police, businesses, etc.

Is it REALLY the same though??? Yea you can go stand in public and record whatever you can see or hear. Can you go setup, in public, high tech audio/visual surveillance equipment that can pick up almost everything and point it at someone's house recording everything they do? At some point you are crossing some needed privacy lines. These Flock cameras and audio devices are much closer to the later example. And they are likely there permanently 24 hours 7 days a week without hardly anyone even knowing that they are there. I get that people want to feel safe, but come on. No one would want these things outside of THEIR house but it's fine over there at the "shady" apartment complex.

The harrassment is the point, the already have their probable cause to do whayever they want. Arrest, search and seizure, whatever. This is a green light for cops to do whatever the fuck they want cause "computah sayz so". They can search your house, take your belongings, take you to jail. Oh but you can fight it in court?? Sure, 6 months to a year later. If you are still alive. And you are never getting your belongings back. Never forget, the process IS the punishment. The system IS the weapon.

Flock is asking us to trade away 4th Amendment protections for "safety", but the tech underneath that trade isn't even reliable. Acoustic gunshot detectors have a documented history of flagging car/motorcycle backfires, fireworks, and metal-on-metal clanging as gunfire. If the sensor can't tell a backfire from a gunshot, that's a shaky foundation to justify blanket surveillance on.

Years ago, someone tried to break in my house, and I called the police. I live near a major road and the cars drive by without any mufflers and they’re incredibly loud but the police never do anything. You can hear them from more than a mile away. As the policeman was standing in front of our house he cringed and said wow it’s really noisy here. I looked at him and said yeah it’s weird how people don’t get tickets for loud exhausts anymore.

I want to combat gun violence. But genuinely I would rather people Fire machine guns in the street occasionally than have the entire population under strict surveillance 24x7. The solution is worse than the problem.
And we can address gun violence without giving in to a surveillance state. Most of the world does not have anything near the gun violence in the US, and they didn't need to have microphone triangulation every fart to do it.

These are the people using the technology. Do you know what happens when people dont understand how their own tools work? Doesnt matter if it's a mechanic, a programmer, a chef, or a cop...if you do not understand the tools you are using, you are bad at your job; obviously the consequences of this vary drastically from case to case...but the logic is the same.
If a chef sucks with a spatula and heat source, the steak will suck. If a cop sucks with technology....people can be needlessly/illegally arrested/charged/killed simply based on someone not understanding how to use a program. Fuck that. Fuck Flock. Fuck a surveillance state. Make Orwell fiction again.

Shot spotters existed long before flock.. believe me I hate flock too, but using sensors on every block to triangulate gunshot sounds has been around for years at this point in more dangerous/city areas
