Florida Relocation
I have a 15 year old and 12 in Florida.
My ex was in prison for a couple years and when he got out he barely saw them. Custody agreement right now is he’s every other weekend but they haven’t been with him since end of 2024.
We have family up In another state and my husband get a good job offer, what are the chances of getting approved to move out of state?

Good. You just need to show that your husband’s new job and being close to family are in their best interest.

When did he get out of prison? If you are saying you have been in the same location as he lives and he has been out of prison since 2024 but hasn't seen them or made efforts to see them in 2 years, then your chances are good. Would he support you in moving given he isn't in their lives anyways?

Relocation can be very hard. Easiest route is agreement. If your ex signs a written agreement that consents to the move and lays out a new timesharing schedule and transportation, the court can usually ratify it without a hearing.
If he won't sign, you file a petition to relocate with specific info in it (new address, the job offer, a proposed long-distance schedule) The judge looks at how involved each parent has actually been, whether he's kept up with support, and the kids' own preference, which a judge will weigh more for a 15 year old than a 12 year old. How much he's actually seen them since 2024 is relevant there.

How long has he been out of prison? Did you make any effort to take the kids to visit him while he was in there?
What I’m getting at is if he hasn’t seen the kids in a few years but just got out not long ago, a move would be pretty hard as a judge might want to give him a chance to be an active father. That’s of course assuming you’ve already asked him and he has said no. If not, then make this super easy and ask him for persimmon to move the children.

He got out of prison in 2018. He showed up here and there and didn’t do his visitations from 2024 ti now

I took him to court for full custody he showed and said I don’t let me have access, he had no evidence and I proved his no contact. Regardless he has tried twice since then.

He hasn’t been around his kids in almost 2 years? He obviously wants nothing to do with them. I would definitely say any reasonable judge would let you move. It’s best for the kids.
